8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subsection (b), Section 574.081, Health and | |
10 | 10 | Safety Code, is amended to read as follows: | |
11 | 11 | (b) The physician shall prepare the plan as prescribed by | |
12 | 12 | department rules and shall consult the patient and the local mental | |
13 | 13 | health authority in the area in which the patient will reside before | |
14 | 14 | preparing the plan. The plan shall specifically address | |
15 | 15 | transportation of the patient after discharge and coordination of | |
16 | 16 | that issue with the local mental health authority and other | |
17 | 17 | appropriate persons with whom the patient has authorized | |
18 | 18 | communication. The local mental health authority is not required | |
19 | 19 | to participate in preparing a plan for a patient furloughed or | |
20 | 20 | discharged from a private mental health facility. | |
21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
25 | 25 | Act takes effect September 1, 2009. |
