7 | 7 | | relating to sanctions available for certain academically |

8 | 8 | | unacceptable campuses. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 39.1323, Education Code, is amended by |
---|
11 | 11 | | adding Subsection (g) to read as follows: |
---|
12 | 12 | | (g) Notwithstanding any other provision of this subchapter, |
---|
13 | 13 | | the commissioner may not impose on a campus for which a campus |
---|
14 | 14 | | intervention team has been appointed under Section 39.1322(b) any |
---|
15 | 15 | | additional sanctions until: |
---|
16 | 16 | | (1) the campus intervention team has completed the |
---|
17 | 17 | | comprehensive on-site evaluation required under Subsection (a)(1) |
---|
18 | 18 | | and the comprehensive on-site needs assessment under Subsection |
---|
19 | 19 | | (b); |
---|
20 | 20 | | (2) the campus intervention team has made |
---|
21 | 21 | | recommendations for a school improvement plan as provided by |
---|
22 | 22 | | Subsection (a)(3); |
---|
23 | 23 | | (3) the campus has received any financial or other |
---|
24 | 24 | | assistance determined necessary under the evaluation process to |
---|
25 | 25 | | implement the school improvement plan; and |
---|
26 | 26 | | (4) the campus has two complete school years during |
---|
27 | 27 | | which to implement the school improvement plan. |
---|
28 | 28 | | SECTION 2. Sections 39.1324(a), (b), (c), and (d), |
---|
29 | 29 | | Education Code, are amended to read as follows: |
---|
30 | 30 | | (a) If a campus has been identified as academically |
---|
31 | 31 | | unacceptable for two consecutive school years, including the |
---|
32 | 32 | | current school year, and has been capable as provided by Section |
---|
33 | 33 | | 39.1323(g) of implementing a school improvement plan for two |
---|
34 | 34 | | complete school years after the appointment of a campus |
---|
35 | 35 | | intervention team under Section 39.1322(b), the commissioner may |
---|
36 | 36 | | [shall] order the reconstitution of the campus and assign a campus |
---|
37 | 37 | | intervention team under this section. In reconstituting the |
---|
38 | 38 | | campus, a campus intervention team shall assist the campus in: |
---|
39 | 39 | | (1) developing a revised school improvement plan; |
---|
40 | 40 | | (2) obtaining approval of the plan from the |
---|
41 | 41 | | commissioner; and |
---|
42 | 42 | | (3) executing the plan on approval by the |
---|
43 | 43 | | commissioner. |
---|
44 | 44 | | (b) The campus intervention team shall decide which |
---|
45 | 45 | | educators may be retained at that campus. A principal who has been |
---|
46 | 46 | | employed by the campus in that capacity during the full two-year |
---|
47 | 47 | | period during which the campus has been identified as academically |
---|
48 | 48 | | unacceptable [described by Subsection (a)] may not be retained at |
---|
49 | 49 | | that campus. A teacher of a subject assessed by an assessment |
---|
50 | 50 | | instrument under Section 39.023 may be retained only if the campus |
---|
51 | 51 | | intervention team determines that a pattern exists of significant |
---|
52 | 52 | | academic improvement by students taught by the teacher. If an |
---|
53 | 53 | | educator is not retained, the educator may be assigned to another |
---|
54 | 54 | | position in the district. |
---|
55 | 55 | | (c) A campus subject to Subsection (a) shall implement the |
---|
56 | 56 | | revised school improvement plan as approved by the commissioner. |
---|
57 | 57 | | The commissioner may appoint a monitor, conservator, management |
---|
58 | 58 | | team, or [a] board of managers to the district to ensure and oversee |
---|
59 | 59 | | the implementation of the school improvement plan. |
---|
60 | 60 | | (d) Notwithstanding any other provision of this subchapter, |
---|
61 | 61 | | after the commissioner has ordered reconstitution of a campus under |
---|
62 | 62 | | this section and the campus has been capable of implementing a |
---|
63 | 63 | | revised school improvement plan as approved by the commissioner for |
---|
64 | 64 | | two complete school years: |
---|
65 | 65 | | (1) if the commissioner determines that the [a] campus |
---|
66 | 66 | | [subject to Subsection (a)] is not fully implementing the revised |
---|
67 | 67 | | school improvement plan or the campus's students fail to |
---|
68 | 68 | | demonstrate improved performance in the areas targeted by the |
---|
69 | 69 | | revised plan, the commissioner may pursue alternative management of |
---|
70 | 70 | | the campus under Section 39.1327; and |
---|
71 | 71 | | (2) if the campus's students demonstrate improved |
---|
72 | 72 | | performance in the areas targeted by the revised school improvement |
---|
73 | 73 | | plan, the commissioner may not impose any additional sanction on |
---|
74 | 74 | | the campus [or may order closure of the campus]. |
---|
75 | 75 | | SECTION 3. Subchapter G, Chapter 39, Education Code, is |
---|
76 | 76 | | amended by adding Section 39.1325 to read as follows: |
---|
77 | 77 | | Sec. 39.1325. CAMPUS NAME CHANGE PROHIBITED. |
---|
78 | 78 | | Notwithstanding any other provision of this subchapter, in |
---|
79 | 79 | | reconstituting a campus, redesigning a campus, or imposing any |
---|
80 | 80 | | other sanction on a campus under this subchapter, the name of the |
---|
81 | 81 | | campus may not be changed. |
---|
82 | 82 | | SECTION 4. Section 13.1327(a), Education Code, is amended |
---|
83 | 83 | | to read as follows: |
---|
84 | 84 | | (a) A campus may be subject to this section if the campus has |
---|
85 | 85 | | been identified as academically unacceptable under Section 39.132 |
---|
86 | 86 | | and the commissioner orders alternative management under Section |
---|
87 | 87 | | 39.1324(d)[, (e), or (f)]. |
---|
88 | 88 | | SECTION 5. Sections 39.1324(e) and (f), Education Code, are |
---|
89 | 89 | | repealed. |
---|
90 | 90 | | SECTION 6. This Act applies beginning with the 2009-2010 |
---|
91 | 91 | | school year. |
---|
92 | 92 | | SECTION 7. This Act takes effect immediately if it receives |
---|
93 | 93 | | a vote of two-thirds of all the members elected to each house, as |
---|
94 | 94 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
95 | 95 | | Act does not receive the vote necessary for immediate effect, this |
---|
96 | 96 | | Act takes effect September 1, 2009. |
