 A BILL TO BE ENTITLED
 AN ACT
 relating to certain prohibited lottery games.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 466.024, Government Code, is amended by
 adding Subsection (a-1) to read as follows:
 (a-1)  The commission or a lottery operator may not establish
 or operate a scratch-off or other instant game for which the price
 of a ticket is greater than $25.
 SECTION 2. On or after the effective date of this Act, a
 sales agent may not offer for sale a scratch-off or other instant
 lottery game ticket at a price greater than the maximum ticket price
 authorized by Section 466.024(a-1), Government Code, as added by
 this Act, for an instant lottery game established before the
 effective date of this Act.
 SECTION 3. Notwithstanding Section 466.024(a-1),
 Government Code, as added by this Act, the Texas Lottery Commission
 or a sales agent may, on or after the effective date of this Act, pay
 prizes in the manner otherwise provided by law for winning tickets
 in a scratch-off or other instant lottery game for which the ticket
 price was greater than the maximum ticket price authorized by
 Section 466.024(a-1) and for which the ticket was sold before the
 effective date of this Act.
 SECTION 4. This Act takes effect January 1, 2010.
