7 | 7 | | relating to the state employee wellness program. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 664.053(b), Government Code, is amended |
---|
10 | 10 | | to read as follows: |
---|
11 | 11 | | (b) The statewide wellness coordinator shall: |
---|
12 | 12 | | (1) coordinate with other agencies that administer a |
---|
13 | 13 | | health benefits program under Chapter 1551, Insurance Code, as |
---|
14 | 14 | | necessary to develop the model wellness program, prevent |
---|
15 | 15 | | duplication of efforts, provide information and resources to |
---|
16 | 16 | | employees, and encourage the use of wellness benefits included in |
---|
17 | 17 | | the health benefits program; |
---|
18 | 18 | | (2) maintain a set of Internet links to health |
---|
19 | 19 | | resources for use by state employees; |
---|
20 | 20 | | (3) design an outreach campaign to educate state |
---|
21 | 21 | | employees about health and fitness-related resources, including |
---|
22 | 22 | | available exercise facilities, online tools, and health and |
---|
23 | 23 | | fitness-related organizations; |
---|
24 | 24 | | (4) study the implementation and participation rates |
---|
25 | 25 | | of state agency worksite wellness programs and report the findings |
---|
26 | 26 | | to the legislature biennially; [and] |
---|
27 | 27 | | (5) organize an annual conference hosted by the |
---|
28 | 28 | | department for all state agency wellness councils; and |
---|
29 | 29 | | (6) create an online questionnaire for state agency |
---|
30 | 30 | | heads to report information, including: |
---|
31 | 31 | | (A) the agency policy on leave time for employees |
---|
32 | 32 | | to complete a health risk assessment; |
---|
33 | 33 | | (B) the agency policy on leave time for employees |
---|
34 | 34 | | to receive an annual physical examination; |
---|
35 | 35 | | (C) the agency policy on providing employees time |
---|
36 | 36 | | during the workday to exercise; and |
---|
37 | 37 | | (D) whether the agency has a wellness coordinator |
---|
38 | 38 | | or council. |
---|
39 | 39 | | SECTION 2. Section 664.061, Government Code, is amended to |
---|
40 | 40 | | read as follows: |
---|
41 | 41 | | Sec. 664.061. AGENCY WELLNESS POLICIES. (a) A state agency |
---|
42 | 42 | | shall create a worksite wellness policy that is annually updated |
---|
43 | 43 | | and submitted to the statewide wellness coordinator. |
---|
44 | 44 | | (b) The executive head of a state agency shall submit the |
---|
45 | 45 | | agency's worksite wellness information to the statewide wellness |
---|
46 | 46 | | coordinator annually through the online questionnaire under |
---|
47 | 47 | | Section 664.053(b)(6). |
---|
48 | 48 | | (c) A state agency may: |
---|
49 | 49 | | (1) allow each employee 30 minutes during normal |
---|
50 | 50 | | working hours for exercise three times each week; |
---|
51 | 51 | | (2) allow all employees to attend on-site wellness |
---|
52 | 52 | | seminars when offered; and |
---|
53 | 53 | | (3) provide four [eight] hours of additional leave |
---|
54 | 54 | | time each year to an employee who [: |
---|
55 | 55 | | [(A)] receives a physical examination. |
---|
56 | 56 | | (d) A state agency shall provide four hours of leave time |
---|
57 | 57 | | each year to an employee who [; and |
---|
58 | 58 | | [(B)] completes either an online health risk |
---|
59 | 59 | | assessment tool provided by the board or a similar health risk |
---|
60 | 60 | | assessment conducted in person by a worksite wellness coordinator. |
---|
61 | 61 | | SECTION 3. This Act takes effect September 1, 2009. |
