| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 163.002, Election Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 163.002. REQUIRED RULES. (a) A political party that |
|---|
| 13 | 13 | | makes nominations in this state shall adopt rules that: |
|---|
| 14 | 14 | | (1) prescribe the parliamentary procedure governing |
|---|
| 15 | 15 | | the conduct of party meetings and conventions from the precinct |
|---|
| 16 | 16 | | level to the state level, including: |
|---|
| 17 | 17 | | (A) quorums; |
|---|
| 18 | 18 | | (B) casting and counting votes; |
|---|
| 19 | 19 | | (C) operation of executive committees; |
|---|
| 20 | 20 | | (D) appointment and duties of convention |
|---|
| 21 | 21 | | committees; and |
|---|
| 22 | 22 | | (E) presentation of matters before a convention; |
|---|
| 23 | 23 | | (2) prescribe the method of selecting the party's |
|---|
| 24 | 24 | | presidential elector candidates; |
|---|
| 25 | 25 | | (3) prescribe the manner of selecting party officers, |
|---|
| 26 | 26 | | convention delegates, convention alternates, and convention |
|---|
| 27 | 27 | | officials; |
|---|
| 28 | 28 | | (4) provide for representative apportionment of party |
|---|
| 29 | 29 | | officers, convention delegates, convention alternates, and |
|---|
| 30 | 30 | | convention officials throughout the state on the basis of |
|---|
| 31 | 31 | | population, party strength, or both, within the appropriate |
|---|
| 32 | 32 | | territorial unit; |
|---|
| 33 | 33 | | (5) provide for periodic publication and publicizing |
|---|
| 34 | 34 | | of party rules; and |
|---|
| 35 | 35 | | (6) prescribe the manner of adopting party rules and |
|---|
| 36 | 36 | | amendments to the rules. |
|---|
| 37 | 37 | | (b) A political party adopting rules under this section |
|---|
| 38 | 38 | | shall review rules adopted under subsection (a)(3) no less than |
|---|
| 39 | 39 | | once every two years at the state convention. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2009. |
