66 AN ACT
77 relating to license renewal requirements for licensed professional
88 counselors.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 503.354, Occupations Code, is amended by
1111 adding Subsection (d-1) and amending Subsection (e) to read as
1212 follows:
1313 (d-1) If a person's license has been expired for more than
1414 one year but less than four years, and if the person has not been the
1515 subject of any disciplinary action taken by or pending before the
1616 board on or after the date the license expired, the person may renew
1717 the license by:
1818 (1) fulfilling continuing education requirements as
1919 set by the board; and
2020 (2) paying the renewal fees for each year in which the
2121 license has been expired.
2222 (e) A person whose license has been expired for four years
2323 [one year] or more may not renew the license. The person may obtain
2424 a new license by complying with the requirements and procedures for
2525 obtaining an original license.
2626 SECTION 2. Section 503.354, Occupations Code, as amended by
2727 this Act, applies only to a licensed professional counselor license
2828 renewed on or after the effective date of this Act. A license
2929 renewed before the effective date of this Act is governed by the law
3030 in effect immediately before that date, and the former law is
3131 continued in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2009.
