| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 503.354, Occupations Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (d-1) and amending Subsection (e) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (d-1) If a person's license has been expired for more than |
|---|
| 14 | 14 | | one year but less than four years, and if the person has not been the |
|---|
| 15 | 15 | | subject of any disciplinary action taken by or pending before the |
|---|
| 16 | 16 | | board on or after the date the license expired, the person may renew |
|---|
| 17 | 17 | | the license by: |
|---|
| 18 | 18 | | (1) fulfilling continuing education requirements as |
|---|
| 19 | 19 | | set by the board; and |
|---|
| 20 | 20 | | (2) paying the renewal fees for each year in which the |
|---|
| 21 | 21 | | license has been expired. |
|---|
| 22 | 22 | | (e) A person whose license has been expired for four years |
|---|
| 23 | 23 | | [one year] or more may not renew the license. The person may obtain |
|---|
| 24 | 24 | | a new license by complying with the requirements and procedures for |
|---|
| 25 | 25 | | obtaining an original license. |

| 26 | 26 | | SECTION 2. Section 503.354, Occupations Code, as amended by |
|---|
| 27 | 27 | | this Act, applies only to a licensed professional counselor license |
|---|
| 28 | 28 | | renewed on or after the effective date of this Act. A license |
|---|
| 29 | 29 | | renewed before the effective date of this Act is governed by the law |
|---|
| 30 | 30 | | in effect immediately before that date, and the former law is |
|---|
| 31 | 31 | | continued in effect for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2009. |
