66 AN ACT
77 relating to limitations on increases in the total amount of tuition
88 charged by public institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 54, Education Code, is
1111 amended by adding Section 54.0514 to read as follows:
1212 Sec. 54.0514. LIMITATION ON INCREASE IN TOTAL AMOUNT OF
1313 TUITION. (a) In this section, "tuition" includes:
1414 (1) tuition for which the rates are prescribed by this
1515 chapter; and
1616 (2) tuition charged by an institution of higher
1717 education under Section 54.0513 or another law authorizing an
1818 institution to establish tuition rates.
1919 (b) The total amount of tuition charged by an institution of
2020 higher education to a student may not exceed the total amount of
2121 tuition that the institution would have charged to a similarly
2222 situated student in the preceding academic year by more than five
2323 percent.
2424 (c) For purposes of this section, students are similarly
2525 situated if they share the same residency status, degree program,
2626 course load, course level, tuition exemption status, and other
2727 circumstances affecting the tuition charged to the student.
2828 (d) This section does not ensure that the total amount of
2929 tuition charged to an individual student does not increase by more
3030 than five percent based on a change in the student's residency
3131 status, degree program, course load, course level, tuition
3232 exemption status, or other circumstance affecting the tuition
3333 charged to the student.
3434 (e) The Texas Higher Education Coordinating Board may adopt
3535 rules as necessary to administer this section.
3636 SECTION 2. This Act applies beginning with tuition charged
3737 by public institutions of higher education for the 2010-2011
3838 academic year.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2009.
