| 7 | 7 | | relating to requests to inspect or be provided with copies of |

| 8 | 8 | | information under the public information law. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 552.003(2), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (2) "Manipulation" means the process of modifying, |
|---|
| 13 | 13 | | reordering, or decoding of information with human intervention. |
|---|
| 14 | 14 | | The term includes a search of one or more e-mail or text message |
|---|
| 15 | 15 | | accounts and the retrieval and transfer of e-mails or text messages |
|---|
| 16 | 16 | | that are responsive to a request for public information into a paper |
|---|
| 17 | 17 | | or other format that can be provided to or inspected by the |
|---|
| 18 | 18 | | requestor. |
|---|
| 19 | 19 | | SECTION 2. Section 552.2615(g), Government Code, is amended |
|---|
| 20 | 20 | | to read as follows: |
|---|
| 21 | 21 | | (g) The time deadlines imposed by this section toll [do not |
|---|
| 22 | 22 | | affect] the application of a time deadline imposed on a |
|---|
| 23 | 23 | | governmental body under Subchapter G, beginning on the date the |
|---|
| 24 | 24 | | itemized statement or updated itemized statement is considered to |
|---|
| 25 | 25 | | have been sent by the governmental body under Subsection (e) and |
|---|
| 26 | 26 | | ending on the date the governmental body receives a response from |
|---|
| 27 | 27 | | the requestor. |
|---|
| 28 | 28 | | SECTION 3. Section 552.263(e), Government Code, is amended |
|---|
| 29 | 29 | | to read as follows: |
|---|
| 30 | 30 | | (e) For purposes of Subchapters F and G, if the officer for |
|---|
| 31 | 31 | | public information of a governmental body or the officer's agent |
|---|
| 32 | 32 | | requires a deposit or bond under this section, a request for a copy |
|---|
| 33 | 33 | | of public information is considered to have been received by a |
|---|
| 34 | 34 | | governmental body on, as applicable, the date the governmental body |
|---|
| 35 | 35 | | receives the deposit or bond for payment of anticipated costs or |
|---|
| 36 | 36 | | unpaid amounts or the date the governmental body receives from the |
|---|
| 37 | 37 | | requestor in accordance with Section 552.2615 a modified, amended, |
|---|
| 38 | 38 | | or narrowed request [if the governmental body's officer for public |
|---|
| 39 | 39 | | information or the officer's agent requires a deposit or bond in |
|---|
| 40 | 40 | | accordance with this section]. |
|---|
| 41 | 41 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 42 | 42 | | to a request to inspect or copy public information received by a |
|---|
| 43 | 43 | | governmental body on or after the effective date of this Act. |
|---|
| 44 | 44 | | SECTION 5. This Act takes effect September 1, 2009. |
