66 relating to multidistrict litigation.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 74.162, Government Code, is amended to
99 read as follows:
1010 Sec. 74.162. TRANSFER OF CASES BY PANEL. Notwithstanding
1111 any other law to the contrary, the judicial panel on multidistrict
1212 litigation may transfer civil actions under Chapter 90 and Chapter
1313 82.007, Civil Practices and Remedies Code, involving one or more
1414 common questions of fact pending in the same or different
1515 constitutional courts, county courts at law, probate courts, or
1616 district courts to any district court for consolidated or
1717 coordinated pretrial proceedings, including summary judgment or
1818 other dispositive motions, but not for trial on the merits. A
1919 transfer may be made by the judicial panel on multidistrict
2020 litigation on its determination that the transfer will:
2121 (1) be for the convenience of the parties and
2222 witnesses; and
2323 (2) promote the just and efficient conduct of the
2424 actions.
2525 SECTION 2. This Act applies only to an action commenced on
2626 or after the effective date of this Act. An action that is
2727 commenced before the effective date of this Act is governed by the
2828 law applicable to the action immediately before the effective date
2929 of this Act, and that law is continued in effect for that purpose.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2009.
