| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter D, Chapter 39, Utilities Code, is | |
| 11 | 11 | amended by adding Section 39.1516 to read as follows: | |
| 12 | 12 | Sec. 39.1516. DISCLOSURE OF ELECTRICITY GENERATION OFFERS. | |
| 13 | 13 | (a) An independent organization certified under Section 39.151 | |
| 14 | 14 | shall disclose all electricity generation offers in the balancing | |
| 15 | 15 | energy market received by the organization. A disclosure under | |
| 16 | 16 | this section shall: | |
| 17 | 17 | (1) be posted on the organization's Internet website | |
| 18 | 18 | not more than two days after the offer is received; and | |
| 19 | 19 | (2) include: | |
| 20 | 20 | (A) the identity of the generation entity making | |
| 21 | 21 | the offer; | |
| 22 | 22 | (B) the amount of the offer; and | |
| 23 | 23 | (C) the location and period for which the offer | |
| 24 | 24 | is made. | |
| 25 | 25 | (b) The commission shall adopt rules as necessary to | |
| 26 | 26 | implement this section. | |
| 27 | 27 | SECTION 2. This Act takes effect September 1, 2009. |
