6	6	relating to the amount and use of certain fees imposed in connection
7	7	with oil and gas activities.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Subsection (a), Section 81.116, Natural
10	10	Resources Code, is amended to read as follows:
11	11	(a) An oil-field cleanup regulatory fee is imposed on crude
12	12	petroleum produced in this state in the amount of five-sixteenths
13	13	[five-eighths] of one cent on each barrel of 42 standard gallons.
14	14	SECTION 2. Subsection (a), Section 81.117, Natural
15	15	Resources Code, is amended to read as follows:
16	16	(a) An oil-field cleanup regulatory fee is imposed on gas
17	17	initially produced and saved in this state in the amount of
18	18	one-thirtieth [one-fifteenth] of one cent for each thousand cubic
19	19	feet.
20	20	SECTION 3. Subsection (d), Section 85.2021, Natural
21	21	Resources Code, is amended to read as follows:
22	22	(d) One-half of the [All] fees collected under this section
23	23	shall be deposited in the state oil-field cleanup fund, and
24	24	one-half of the fees collected under this section shall be
25	25	deposited in the oil and gas regulatory and development fund.
26	26	SECTION 4. Subchapter F, Chapter 85, Natural Resources
27	27	Code, is amended by adding Section 85.2022 to read as follows:
28	28	Sec. 85.2022. OIL AND GAS REGULATORY AND DEVELOPMENT FUND.
29	29	(a) The oil and gas regulatory and development fund is created as a
30	30	special account in the general revenue fund. The fund consists of
31	31	one-half of the fees imposed under Section 85.2021.
32	32	(b) Money in the fund may be appropriated only to the
33	33	commission for activities related to the regulation and development
34	34	of oil and gas.
35	35	SECTION 5. Subsection (c), Section 91.111, Natural
36	36	Resources Code, is amended to read as follows:
37	37	(c) The fund consists of:
38	38	(1) penalties imposed under Section 85.381 for
39	39	violation of a law, order, or rule relating to well plugging
40	40	requirements;
41	41	(2) proceeds from bonds and other financial security
42	42	required by this chapter and benefits under well-specific plugging
43	43	insurance policies described by Section 91.104(c) that are paid to
44	44	the state as contingent beneficiary of the policies, subject to the
45	45	refund provisions of Section 91.1091, if applicable;
46	46	(3) private contributions, including contributions
47	47	made under Section 89.084;
48	48	(4) expenses collected under Section 89.083;
49	49	(5) one-half of the fees imposed under Section
50	50	85.2021;
51	51	(6) civil penalties collected for violations of
52	52	Chapter 89 or of rules or orders relating to plugging that are
53	53	adopted under this code;
54	54	(7) proceeds collected under Sections 89.085 and
55	55	91.115;
56	56	(8) interest earned on the funds deposited in the
57	57	fund;
58	58	(9) civil penalties or costs recovered under Section
59	59	91.457 or 91.459;
60	60	(10) oil and gas waste hauler permit application fees
61	61	collected under Section 29.015, Water Code;
62	62	(11) costs recovered under Section 91.113(f);
63	63	(12) hazardous oil and gas waste generation fees
64	64	collected under Section 91.605;
65	65	(13) oil-field cleanup regulatory fees on oil
66	66	collected under Section 81.116;
67	67	(14) oil-field cleanup regulatory fees on gas
68	68	collected under Section 81.117;
69	69	(15) fees for a reissued certificate collected under
70	70	Section 91.707;
71	71	(16) fees collected under Section 91.1013;
72	72	(17) fees collected under Section 89.088;
73	73	(18) penalties collected under Section 81.0531;
74	74	(19) fees collected under Section 91.142;
75	75	(20) fees collected under Section 91.654;
76	76	(21) costs recovered under Sections 91.656 and 91.657;
77	77	(22) two-thirds of the fees collected under Section
78	78	81.0521; and
79	79	(23) legislative appropriations.
80	80	SECTION 6. This Act takes effect September 1, 2009.
