55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the maintenance of health care provider lists under the
88 Medicaid and child health plan programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0393 to read as follows:
1212 Sec. 531.0393. HEALTH CARE PROVIDER LISTS UNDER CERTAIN
1313 HEALTH BENEFITS PLANS AND PROGRAMS. The commission shall include
1414 in each contract between the commission and a health benefits plan
1515 provider under the Medicaid program, including the STAR program or
1616 any other Medicaid managed care program, or the child health plan
1717 program a requirement that the health benefits plan provider
1818 maintain accurate and comprehensive lists of health care providers
1919 providing services to enrollees under the health benefits plan.
2020 Each list of health care providers must:
2121 (1) be updated at least as frequently as required by
2222 the commission in the contract; and
2323 (2) indicate which health care providers providing
2424 services to enrollees under the health benefits plan are no longer
2525 accepting new patients.
2626 SECTION 2. (a) Section 531.0393, Government Code, as added
2727 by this Act, applies to a contract entered into or renewed on or
2828 after the effective date of this Act.
2929 (b) To the extent permitted by law or the terms of the
3030 contract, the Health and Human Services Commission shall amend a
3131 contract entered into before the effective date of this Act with a
3232 health benefits plan provider to require compliance with Section
3333 531.0393, Government Code, as added by this Act.
3434 SECTION 3. If before implementing any provision of this Act
3535 a state agency determines that a waiver or authorization from a
3636 federal agency is necessary for implementation of that provision,
3737 the agency affected by the provision shall request the waiver or
3838 authorization and may delay implementing that provision until the
3939 waiver or authorization is granted.
4040 SECTION 4. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2009.
