| 7 | 7 | | relating to the maintenance of health care provider lists under the |
|---|
| 8 | 8 | | Medicaid and child health plan programs. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 531.0393 to read as follows: |
|---|
| 12 | 12 | | Sec. 531.0393. HEALTH CARE PROVIDER LISTS UNDER CERTAIN |
|---|
| 13 | 13 | | HEALTH BENEFITS PLANS AND PROGRAMS. The commission shall include |
|---|
| 14 | 14 | | in each contract between the commission and a health benefits plan |
|---|
| 15 | 15 | | provider under the Medicaid program, including the STAR program or |
|---|
| 16 | 16 | | any other Medicaid managed care program, or the child health plan |
|---|
| 17 | 17 | | program a requirement that the health benefits plan provider |
|---|
| 18 | 18 | | maintain accurate and comprehensive lists of health care providers |
|---|
| 19 | 19 | | providing services to enrollees under the health benefits plan. |
|---|
| 20 | 20 | | Each list of health care providers must: |
|---|
| 21 | 21 | | (1) be updated at least as frequently as required by |
|---|
| 22 | 22 | | the commission in the contract; and |
|---|
| 23 | 23 | | (2) indicate which health care providers providing |
|---|
| 24 | 24 | | services to enrollees under the health benefits plan are no longer |
|---|
| 25 | 25 | | accepting new patients. |
|---|
| 26 | 26 | | SECTION 2. (a) Section 531.0393, Government Code, as added |
|---|
| 27 | 27 | | by this Act, applies to a contract entered into or renewed on or |
|---|
| 28 | 28 | | after the effective date of this Act. |
|---|
| 29 | 29 | | (b) To the extent permitted by law or the terms of the |
|---|
| 30 | 30 | | contract, the Health and Human Services Commission shall amend a |
|---|
| 31 | 31 | | contract entered into before the effective date of this Act with a |
|---|
| 32 | 32 | | health benefits plan provider to require compliance with Section |
|---|
| 33 | 33 | | 531.0393, Government Code, as added by this Act. |
|---|
| 34 | 34 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 35 | 35 | | a state agency determines that a waiver or authorization from a |
|---|
| 36 | 36 | | federal agency is necessary for implementation of that provision, |
|---|
| 37 | 37 | | the agency affected by the provision shall request the waiver or |
|---|
| 38 | 38 | | authorization and may delay implementing that provision until the |
|---|
| 39 | 39 | | waiver or authorization is granted. |
|---|
| 40 | 40 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2009. |
