A BILL TO BE ENTITLED
AN ACT
relating to the authority of certain municipalities to use hotel
occupancy tax revenue for certain venue projects.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 334.2516(a), Local Government Code, is
amended to read as follows:
(a) This section applies only to a municipality that:
(1) is located in three counties;
(2) has a population of less than 130,000 as shown by
the 2000 federal decennial census [120,000]; and
(3) acquires by purchase or lease with a term of not
less than 20 years an interest in real property that by the terms of
the acquisition is required to be maintained as park property.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
