8 | 8 | an agreement with a school district to dedicate revenue from a tax | |
9 | 9 | increment fund to the district for the acquisition, construction, | |
10 | 10 | or reconstruction of an educational facility. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 311.0085(a), Tax Code, is amended to | |
13 | 13 | read as follows: | |
14 | 14 | (a) This section applies only to a municipality with a | |
15 | 15 | population of less than 130,000 as shown by the 2000 federal | |
16 | 16 | decennial census that has[: | |
17 | 17 | [(1)] territory in three counties[; and | |
18 | 18 | [(2) a population of less than 120,000]. | |
19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect September 1, 2009. |
