| 8 | 8 | | jails to the Texas Department of Criminal Justice. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter F, Chapter 499, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 499.127 to read as follows: |
|---|
| 12 | 12 | | Sec. 499.127. REQUIRED TRANSFER OF INMATES FROM CERTAIN |
|---|
| 13 | 13 | | COUNTIES. (a) This section applies only to the department's |
|---|
| 14 | 14 | | acceptance of an inmate who is under an order of commitment to the |
|---|
| 15 | 15 | | department and who is confined in a county jail in a county in which |
|---|
| 16 | 16 | | the average number of days that an inmate eligible for transfer to |
|---|
| 17 | 17 | | the department remains in the county jail exceeds the statewide |
|---|
| 18 | 18 | | average number of days an inmate eligible for transfer remains in a |
|---|
| 19 | 19 | | county jail before the inmate is accepted by the department. |
|---|
| 20 | 20 | | (b) Notwithstanding Section 499.121(c) or any other law, |
|---|
| 21 | 21 | | the department shall accept an inmate described by Subsection (a) |
|---|
| 22 | 22 | | not later than the date that corresponds to the statewide average |
|---|
| 23 | 23 | | number of days an inmate eligible for transfer remains in a county |
|---|
| 24 | 24 | | jail before the inmate is accepted by the department. |
|---|
| 25 | 25 | | SECTION 2. Section 499.127, Government Code, as added by |
|---|
| 26 | 26 | | this Act, applies only to the acceptance by the Texas Department of |
|---|
| 27 | 27 | | Criminal Justice of an inmate who is confined in a county jail and |
|---|
| 28 | 28 | | is under an order of commitment to the department that is entered on |
|---|
| 29 | 29 | | or after the effective date of this Act. The acceptance by the |
|---|
| 30 | 30 | | Texas Department of Criminal Justice of an inmate who is confined in |
|---|
| 31 | 31 | | a county jail and is under an order of commitment to the department |
|---|
| 32 | 32 | | that is entered before the effective date of this Act is governed by |
|---|
| 33 | 33 | | the law in effect on the date the order of commitment was entered, |
|---|
| 34 | 34 | | and the former law is continued in effect for that purpose. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2009. |
