55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the timely transfer of inmates from certain county
88 jails to the Texas Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 499, Government Code, is
1111 amended by adding Section 499.127 to read as follows:
1212 Sec. 499.127. REQUIRED TRANSFER OF INMATES FROM CERTAIN
1313 COUNTIES. (a) This section applies only to the department's
1414 acceptance of an inmate who is under an order of commitment to the
1515 department and who is confined in a county jail in a county in which
1616 the average number of days that an inmate eligible for transfer to
1717 the department remains in the county jail exceeds the statewide
1818 average number of days an inmate eligible for transfer remains in a
1919 county jail before the inmate is accepted by the department.
2020 (b) Notwithstanding Section 499.121(c) or any other law,
2121 the department shall accept an inmate described by Subsection (a)
2222 not later than the date that corresponds to the statewide average
2323 number of days an inmate eligible for transfer remains in a county
2424 jail before the inmate is accepted by the department.
2525 SECTION 2. Section 499.127, Government Code, as added by
2626 this Act, applies only to the acceptance by the Texas Department of
2727 Criminal Justice of an inmate who is confined in a county jail and
2828 is under an order of commitment to the department that is entered on
2929 or after the effective date of this Act. The acceptance by the
3030 Texas Department of Criminal Justice of an inmate who is confined in
3131 a county jail and is under an order of commitment to the department
3232 that is entered before the effective date of this Act is governed by
3333 the law in effect on the date the order of commitment was entered,
3434 and the former law is continued in effect for that purpose.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2009.
