8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter Z, Chapter 44, Education Code, is |
---|
10 | 10 | | amended by adding Section 44.907 to read as follows: |
---|
11 | 11 | | Sec. 44.907. INTERIM STUDY REGARDING PUBLIC SCHOOL FACILITY |
---|
12 | 12 | | NEEDS; ADVISORY PANEL. (a) The commissioner shall establish an |
---|
13 | 13 | | advisory panel to conduct a study of public school facility needs. |
---|
14 | 14 | | The advisory panel is composed of six members as follows: |
---|
15 | 15 | | (1) one member is the state demographer or the state |
---|
16 | 16 | | demographer's designee; |
---|
17 | 17 | | (2) one member who is a superintendent or a chief |
---|
18 | 18 | | financial officer of a small school district; |
---|
19 | 19 | | (3) one member who is a superintendent or a chief |
---|
20 | 20 | | financial officer of a midsize school district; |
---|
21 | 21 | | (4) one member who is a superintendent or a chief |
---|
22 | 22 | | financial officer of an urban school district; |
---|
23 | 23 | | (5) one member who is a superintendent or a chief |
---|
24 | 24 | | financial officer of a rural school district; and |
---|
25 | 25 | | (6) one member who is a superintendent or a chief |
---|
26 | 26 | | financial officer of a fast growth school district. A fast growth |
---|
27 | 27 | | school district is any school district that has more than 3,400 |
---|
28 | 28 | | weighted students in average daily attendance (WADA), and has |
---|
29 | 29 | | enrollment growth of at least 10 percent over the last five years, |
---|
30 | 30 | | or has a net increase of 5000 WADA in any given year. |
---|
31 | 31 | | (7) All members of this advisory panel, except for the |
---|
32 | 32 | | state demographer or the state demographer's designee, represent |
---|
33 | 33 | | districts that have a total taxable property value per student in |
---|
34 | 34 | | average daily attendance that is less than the total taxable |
---|
35 | 35 | | property value per student in average daily attendance available to |
---|
36 | 36 | | the Austin Independent School District as of September 1, 2009. |
---|
37 | 37 | | (b) The commissioner shall by rule establish criteria for |
---|
38 | 38 | | the school district categories specified by Subsection (a). |
---|
39 | 39 | | (c) The commissioner shall designate one member of the |
---|
40 | 40 | | advisory panel as the presiding officer. |
---|
41 | 41 | | (d) The state demographer shall design a survey to request |
---|
42 | 42 | | that each school district, with a total taxable property value per |
---|
43 | 43 | | student in average daily attendance that is less than the total |
---|
44 | 44 | | taxable property value per student in average daily attendance |
---|
45 | 45 | | available to the Austin Independent School District as of September |
---|
46 | 46 | | 1, 2009, project the facility needs of the school district for the |
---|
47 | 47 | | next five years by: |
---|
48 | 48 | | (1) identifying the number of: |
---|
49 | 49 | | (A) new facilities needed; and |
---|
50 | 50 | | (B) potential projects requiring the expansion |
---|
51 | 51 | | or renovation of existing facilities; and |
---|
52 | 52 | | (2) classifying each item listed in Subdivision (1) by |
---|
53 | 53 | | academic level and purpose, including administrative, |
---|
54 | 54 | | instructional, athletic, or support. |
---|
55 | 55 | | (e) After the state demographer has designed the survey, the |
---|
56 | 56 | | advisory panel shall review the survey to determine if: |
---|
57 | 57 | | (1) the survey is properly designed to obtain the |
---|
58 | 58 | | information intended to be obtained; and |
---|
59 | 59 | | (2) each school district can reasonably complete the |
---|
60 | 60 | | survey. |
---|
61 | 61 | | (f) The advisory panel may require the state demographer to |
---|
62 | 62 | | make changes to the survey, including providing or requesting |
---|
63 | 63 | | additional information. |
---|
64 | 64 | | (g) After the advisory panel approves the survey, each |
---|
65 | 65 | | regional education service center shall: |
---|
66 | 66 | | (1) distribute the survey to each school district in |
---|
67 | 67 | | the region; |
---|
68 | 68 | | (2) provide a method for each district to return the |
---|
69 | 69 | | survey results to the regional education service center; and |
---|
70 | 70 | | (3) report the results collected in response to the |
---|
71 | 71 | | survey to the advisory panel. |
---|
72 | 72 | | (h) Not later than September 1, 2010, the advisory panel |
---|
73 | 73 | | shall report the results and any conclusions the advisory panel |
---|
74 | 74 | | draws from the results to the agency, the governor, the lieutenant |
---|
75 | 75 | | governor, the speaker of the house of representatives, and the |
---|
76 | 76 | | standing legislative committees with primary jurisdiction over |
---|
77 | 77 | | public education. |
---|
78 | 78 | | (i) In addition to the survey described by Subsection (d), |
---|
79 | 79 | | the state demographer shall provide to the advisory panel a |
---|
80 | 80 | | projection of student enrollment growth in each school district for |
---|
81 | 81 | | the next 10 years. |
---|
82 | 82 | | (j) The section expires September 1, 2011. |
---|
83 | 83 | | SECTION 2. This Act takes effect immediately if it receives |
---|
84 | 84 | | a vote of two-thirds of all the members elected to each house, as |
---|
85 | 85 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
86 | 86 | | Act does not receive the vote necessary for immediate effect, this |
---|
87 | 87 | | Act takes effect September 1, 2009. |
