55 AN ACT
66 relating to an interim study to determine public school facility
77 needs.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter Z, Chapter 44, Education Code, is
1010 amended by adding Section 44.907 to read as follows:
1111 Sec. 44.907. INTERIM STUDY REGARDING PUBLIC SCHOOL FACILITY
1212 NEEDS; ADVISORY PANEL. (a) The commissioner shall establish an
1313 advisory panel to conduct a study of public school facility needs.
1414 The advisory panel is composed of six members as follows:
1515 (1) one member is the state demographer or the state
1616 demographer's designee;
1717 (2) one member who is a superintendent or a chief
1818 financial officer of a small school district;
1919 (3) one member who is a superintendent or a chief
2020 financial officer of a midsize school district;
2121 (4) one member who is a superintendent or a chief
2222 financial officer of an urban school district;
2323 (5) one member who is a superintendent or a chief
2424 financial officer of a rural school district; and
2525 (6) one member who is a superintendent or a chief
2626 financial officer of a fast growth school district. A fast growth
2727 school district is any school district that has more than 3,400
2828 weighted students in average daily attendance (WADA), and has
2929 enrollment growth of at least 10 percent over the last five years,
3030 or has a net increase of 5000 WADA in any given year.
3131 (7) All members of this advisory panel, except for the
3232 state demographer or the state demographer's designee, represent
3333 districts that have a total taxable property value per student in
3434 average daily attendance that is less than the total taxable
3535 property value per student in average daily attendance available to
3636 the Austin Independent School District as of September 1, 2009.
3737 (b) The commissioner shall by rule establish criteria for
3838 the school district categories specified by Subsection (a).
3939 (c) The commissioner shall designate one member of the
4040 advisory panel as the presiding officer.
4141 (d) The state demographer shall design a survey to request
4242 that each school district, with a total taxable property value per
4343 student in average daily attendance that is less than the total
4444 taxable property value per student in average daily attendance
4545 available to the Austin Independent School District as of September
4646 1, 2009, project the facility needs of the school district for the
4747 next five years by:
4848 (1) identifying the number of:
4949 (A) new facilities needed; and
5050 (B) potential projects requiring the expansion
5151 or renovation of existing facilities; and
5252 (2) classifying each item listed in Subdivision (1) by
5353 academic level and purpose, including administrative,
5454 instructional, athletic, or support.
5555 (e) After the state demographer has designed the survey, the
5656 advisory panel shall review the survey to determine if:
5757 (1) the survey is properly designed to obtain the
5858 information intended to be obtained; and
5959 (2) each school district can reasonably complete the
6060 survey.
6161 (f) The advisory panel may require the state demographer to
6262 make changes to the survey, including providing or requesting
6363 additional information.
6464 (g) After the advisory panel approves the survey, each
6565 regional education service center shall:
6666 (1) distribute the survey to each school district in
6767 the region;
6868 (2) provide a method for each district to return the
6969 survey results to the regional education service center; and
7070 (3) report the results collected in response to the
7171 survey to the advisory panel.
7272 (h) Not later than September 1, 2010, the advisory panel
7373 shall report the results and any conclusions the advisory panel
7474 draws from the results to the agency, the governor, the lieutenant
7575 governor, the speaker of the house of representatives, and the
7676 standing legislative committees with primary jurisdiction over
7777 public education.
7878 (i) In addition to the survey described by Subsection (d),
7979 the state demographer shall provide to the advisory panel a
8080 projection of student enrollment growth in each school district for
8181 the next 10 years.
8282 (j) The section expires September 1, 2011.
8383 SECTION 2. This Act takes effect immediately if it receives
8484 a vote of two-thirds of all the members elected to each house, as
8585 provided by Section 39, Article III, Texas Constitution. If this
8686 Act does not receive the vote necessary for immediate effect, this
8787 Act takes effect September 1, 2009.
