| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 1301, Occupations Code, is |

| 11 | 11 | | amended by adding Section 1301.004 to read as follows: |

| 12 | 12 | | Sec. 1301.004. NONAPPLICABILITY OF LAW GOVERNING |
|---|
| 13 | 13 | | CANCELLATION OF CERTAIN TRANSACTIONS. Chapter 39, Business & |
|---|
| 14 | 14 | | Commerce Code, does not apply to a good or service provided by a |
|---|
| 15 | 15 | | license holder under this chapter if the transaction involving the |
|---|
| 16 | 16 | | good or service is initiated by the consumer. |

| 17 | 17 | | SECTION 2. Subchapter A, Chapter 1302, Occupations Code, is |

| 18 | 18 | | amended by adding Section 1302.003 to read as follows: |

| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
