66 AN ACT
77 relating to the registration with the Texas Department of Insurance
88 of certain contract examiners.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 751.052, Insurance Code, is amended to
1111 read as follows:
1212 Sec. 751.052. COORDINATION WITH OTHER STATES; REGISTRATION
1313 OF CONTRACT EXAMINER. (a) The commissioner shall coordinate the
1414 department's market analysis and examination efforts with other
1515 states through the National Association of Insurance
1616 Commissioners.
1717 (b) A person with whom another state contracts to perform
1818 any market analysis or examination initiated by the other state of
1919 an insurer domiciled in this state shall register with and provide
2020 the following information to the department's chief examiner:
2121 (1) the person's name;
2222 (2) if the person is not an individual, the identity of
2323 each examiner or other person who will perform any part of the
2424 market analysis or examination;
2525 (3) the name of the state that contracted with the
2626 person;
2727 (4) the identity of the insurer to be examined; and
2828 (5) a description of each issue that the person has
2929 been contracted to examine.
3030 (c) It is a violation of this code for a person to accept
3131 compensation from multiple states for the same examination, if
3232 doing so results in duplicative costs to the insurer being
3333 examined. It is not a violation of this code for:
3434 (1) an examiner to conduct an examination of an
3535 insurer for the benefit of multiple states in a coordinated
3636 examination; and
3737 (2) the examiner to accept compensation from the
3838 states participating in the coordinated examination to reduce the
3939 examination costs to the insurer being examined.
4040 SECTION 2. Subchapter C, Chapter 401, Insurance Code, is
4141 amended by adding Section 401.107 to read as follows:
4242 Sec. 401.107. REGISTRATION OF CONTRACT EXAMINERS. (a) A
4343 person with whom another state contracts to perform any examination
4444 initiated by the other state of an insurer domiciled in this state
4545 shall register with and provide the following information to the
4646 department's chief examiner:
4747 (1) the person's name;
4848 (2) if the person is not an individual, the identity of
4949 each examiner or other person who will perform any part of the
5050 examination;
5151 (3) the name of the state that contracted with the
5252 person;
5353 (4) the identity of the insurer to be examined; and
5454 (5) a description of each issue that the person has
5555 been contracted to examine.
5656 (b) It is a violation of this code for a person to accept
5757 compensation from multiple states for the same examination, if
5858 doing so results in duplicative costs to the insurer being
5959 examined. It is not a violation of this code for:
6060 (1) an examiner to conduct an examination of an
6161 insurer for the benefit of multiple states in a coordinated
6262 examination; and
6363 (2) the examiner to accept compensation from the
6464 states participating in the coordinated examination to reduce the
6565 examination costs to the insurer being examined.
6666 SECTION 3. Section 4053.107, Insurance Code, is amended by
6767 adding Subsections (d) and (e) to read as follows:
6868 (d) A person with whom another state contracts to perform
6969 any examination initiated by the other state of a managing general
7070 agent licensed under this chapter shall register with and provide
7171 the following information to the department's chief examiner:
7272 (1) the person's name;
7373 (2) if the person is not an individual, the identity of
7474 each examiner or other person who will perform any part of the
7575 examination;
7676 (3) the name of the state that contracted with the
7777 person;
7878 (4) the identity of the managing general agent to be
7979 examined; and
8080 (5) a description of each issue that the person has
8181 been contracted to examine.
8282 (e) It is a violation of this code for a person to accept
8383 compensation from multiple states for the same examination, if
8484 doing so results in duplicative costs to the managing general agent
8585 being examined. It is not a violation of this code for:
8686 (1) an examiner to conduct an examination of a
8787 managing general agent for the benefit of multiple states in a
8888 coordinated examination; and
8989 (2) the examiner to accept compensation from the
9090 states participating in the coordinated examination to reduce the
9191 examination costs to the managing general agent being examined.
9292 SECTION 4. This Act takes effect immediately if it receives
9393 a vote of two-thirds of all the members elected to each house, as
9494 provided by Section 39, Article III, Texas Constitution. If this
9595 Act does not receive the vote necessary for immediate effect, this
9696 Act takes effect September 1, 2009.
