| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter F, Chapter 6, Water Code, is amended |
|---|
| 11 | 11 | | by adding Section 6.198 to read as follows: |

| 12 | 12 | | Sec. 6.198. PURCHASE, DONATION, AND SALE OF PROMOTIONAL |
|---|
| 13 | 13 | | ITEMS. (a) The executive administrator, with the approval of the |
|---|
| 14 | 14 | | board and on the board's behalf, may purchase and donate, sell, or |
|---|
| 15 | 15 | | contract for the sale of promotional items, including clothing, |
|---|
| 16 | 16 | | posters, banners, calendars, books, prints, caps, and other items |
|---|
| 17 | 17 | | to promote the programs of the board. |
|---|
| 18 | 18 | | (b) The board may use its Internet website to advertise and |
|---|
| 19 | 19 | | sell the items described by Subsection (a). |
|---|
| 20 | 20 | | (c) Money received from the sale of promotional items under |
|---|
| 21 | 21 | | this section shall be deposited in the general revenue fund and used |
|---|
| 22 | 22 | | by the board to further the purposes and programs of the board. |
|---|
| 23 | 23 | | (d) Section 403.095, Government Code, does not apply to |
|---|
| 24 | 24 | | money deposited under this section. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2009. |
