| 8 | 8 | | institution and the issuance of bonds for that institution. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsection (d), Section 105.501, Education Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | (d) Notwithstanding any other provision of this subchapter, |
|---|
| 13 | 13 | | the University of North Texas at Dallas may operate as a general |
|---|
| 14 | 14 | | academic teaching institution with its own chief executive officer, |
|---|
| 15 | 15 | | administration, and faculty only after the Texas Higher Education |
|---|
| 16 | 16 | | Coordinating Board certifies that enrollment at the University of |
|---|
| 17 | 17 | | North Texas System Center at Dallas has reached an enrollment |
|---|
| 18 | 18 | | equivalent to 1,000 full-time students for one semester. Until |
|---|
| 19 | 19 | | that enrollment level is reached, the board may operate a system |
|---|
| 20 | 20 | | center of the University of North Texas in the city of Dallas. |
|---|
| 21 | 21 | | Prior to reaching 2,500 full-time equivalent students, the |
|---|
| 22 | 22 | | University of North Texas at Dallas may not receive general revenue |
|---|
| 23 | 23 | | in excess of the 2003 expended amount with the exception of funding |
|---|
| 24 | 24 | | provided through the General Academic Instruction and Operations |
|---|
| 25 | 25 | | Formula for semester credit hour increases and the Tuition Revenue |
|---|
| 26 | 26 | | Bond debt service for bonds approved in the 78th Legislature. The |
|---|
| 27 | 27 | | institution will not be eligible to receive the small school |
|---|
| 28 | 28 | | supplement in the General Academic Instruction and Operations |
|---|
| 29 | 29 | | Formula until it reaches 2,500 full-time equivalent student |
|---|
| 30 | 30 | | enrollment. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each House, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
