44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to enrollment requirements for the operation of the
77 University of North Texas at Dallas as a general academic teaching
88 institution and the issuance of bonds for that institution.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (d), Section 105.501, Education Code,
1111 is amended to read as follows:
1212 (d) Notwithstanding any other provision of this subchapter,
1313 the University of North Texas at Dallas may operate as a general
1414 academic teaching institution with its own chief executive officer,
1515 administration, and faculty only after the Texas Higher Education
1616 Coordinating Board certifies that enrollment at the University of
1717 North Texas System Center at Dallas has reached an enrollment
1818 equivalent to 1,000 full-time students for one semester. Until
1919 that enrollment level is reached, the board may operate a system
2020 center of the University of North Texas in the city of Dallas.
2121 Prior to reaching 2,500 full-time equivalent students, the
2222 University of North Texas at Dallas may not receive general revenue
2323 in excess of the 2003 expended amount with the exception of funding
2424 provided through the General Academic Instruction and Operations
2525 Formula for semester credit hour increases and the Tuition Revenue
2626 Bond debt service for bonds approved in the 78th Legislature. The
2727 institution will not be eligible to receive the small school
2828 supplement in the General Academic Instruction and Operations
2929 Formula until it reaches 2,500 full-time equivalent student
3030 enrollment.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each House, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2009.
