55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a municipality to impose a civil
88 penalty on the owner of certain motor vehicles parked on a highway
99 under the jurisdiction of the municipality that do not display a
1010 valid registration insignia or inspection certificate.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 502.003(b), Transportation Code, is
1313 amended to read as follows:
1414 (b) This section does not affect the authority of a
1515 municipality to:
1616 (1) license and regulate the use of motor vehicles for
1717 compensation within the municipal limits; [and]
1818 (2) impose a permit fee or street rental charge for the
1919 operation of each motor vehicle used to transport passengers for
2020 compensation, other than a motor vehicle operating under a
2121 registration certificate from the department or a permit from the
2222 federal Surface Transportation Board; and
2323 (3) impose a civil penalty on the owner of a motor
2424 vehicle that:
2525 (A) displays a license plate issued under this
2626 chapter or Chapter 504;
2727 (B) is parked on a highway under the jurisdiction
2828 of the municipality; and
2929 (C) does not display a valid registration
3030 insignia issued under this chapter or Chapter 504.
3131 SECTION 2. Section 548.602, Transportation Code, is amended
3232 by adding Subsection (b-1) to read as follows:
3333 (b-1) The governing body of a municipality may enact an
3434 ordinance that imposes a civil penalty on the owner of a motor
3535 vehicle that:
3636 (1) displays a license plate issued under Chapter 502
3737 or 504;
3838 (2) is parked on a highway under the jurisdiction of
3939 the municipality; and
4040 (3) does not display a valid inspection certificate
4141 issued under this chapter.
4242 SECTION 3. This Act takes effect September 1, 2009.
