| 7 | 7 | | relating to the authority of a municipality to impose a civil |

| 8 | 8 | | penalty on the owner of certain motor vehicles parked on a highway |
|---|
| 9 | 9 | | under the jurisdiction of the municipality that do not display a |
|---|
| 10 | 10 | | valid registration insignia or inspection certificate. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Section 502.003(b), Transportation Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (b) This section does not affect the authority of a |
|---|
| 15 | 15 | | municipality to: |
|---|
| 16 | 16 | | (1) license and regulate the use of motor vehicles for |
|---|
| 17 | 17 | | compensation within the municipal limits; [and] |
|---|
| 18 | 18 | | (2) impose a permit fee or street rental charge for the |
|---|
| 19 | 19 | | operation of each motor vehicle used to transport passengers for |
|---|
| 20 | 20 | | compensation, other than a motor vehicle operating under a |
|---|
| 21 | 21 | | registration certificate from the department or a permit from the |
|---|
| 22 | 22 | | federal Surface Transportation Board; and |
|---|
| 23 | 23 | | (3) impose a civil penalty on the owner of a motor |
|---|
| 24 | 24 | | vehicle that: |
|---|
| 25 | 25 | | (A) displays a license plate issued under this |
|---|
| 26 | 26 | | chapter or Chapter 504; |
|---|
| 27 | 27 | | (B) is parked on a highway under the jurisdiction |
|---|
| 28 | 28 | | of the municipality; and |
|---|
| 29 | 29 | | (C) does not display a valid registration |
|---|
| 30 | 30 | | insignia issued under this chapter or Chapter 504. |
|---|
| 31 | 31 | | SECTION 2. Section 548.602, Transportation Code, is amended |
|---|
| 32 | 32 | | by adding Subsection (b-1) to read as follows: |
|---|
| 33 | 33 | | (b-1) The governing body of a municipality may enact an |
|---|
| 34 | 34 | | ordinance that imposes a civil penalty on the owner of a motor |
|---|
| 35 | 35 | | vehicle that: |
|---|
| 36 | 36 | | (1) displays a license plate issued under Chapter 502 |
|---|
| 37 | 37 | | or 504; |
|---|
| 38 | 38 | | (2) is parked on a highway under the jurisdiction of |
|---|
| 39 | 39 | | the municipality; and |
|---|
| 40 | 40 | | (3) does not display a valid inspection certificate |
|---|
| 41 | 41 | | issued under this chapter. |

| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2009. |
