55 relating to the creation of a county court at law in Bosque County
66 and the composition of the Bosque, Comanche, and Hamilton Counties

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 25, Government Code, is
1010 amended by adding Sections 25.0201 and 25.0202 to read as follows:
1111 Sec. 25.0201. BOSQUE COUNTY. Bosque County has one
1212 statutory county court, the County Court at Law of Bosque County.
1313 Sec. 25.0202. BOSQUE COUNTY COURT AT LAW PROVISIONS.
1414 (a) In addition to the jurisdiction provided by Section 25.0003
1515 and other law, a county court at law in Bosque County has concurrent
1616 jurisdiction with the district court in:
1717 (1) family law cases and proceedings;
1818 (2) civil cases in which the matter in controversy
1919 exceeds $500 but does not exceed $100,000, excluding interest,
2020 court costs, and attorney's fees; and
2121 (3) contested probate matters under Section 5(b),
2222 Texas Probate Code.
2323 (b) The County Court at Law of Bosque County has primary
2424 jurisdiction over juvenile matters.
2525 (c) A county court at law has the same terms of court as the
2626 County Court of Bosque County.
2727 (d) The judge of a county court at law may not engage in the
2828 private practice of law and must meet the qualifications
2929 established by Section 25.0014.
3030 (e) The judge of a county court at law shall be paid as
3131 provided by Section 25.0005. The judge's salary shall be paid out
3232 of the county treasury on order of the commissioners court.
3333 Notwithstanding any other law, the judge is entitled to necessary
3434 office and operational expenses, including administrative and
3535 clerical personnel, on the approval of the commissioners court.
3636 Administrative and clerical personnel to which a judge is entitled
3737 on approval under this subsection includes a court coordinator,
3838 court reporter, and bailiff.
3939 (f) If a family law case or proceeding is tried before a
4040 jury, the jury shall be composed of 12 members. In all other cases,
4141 except as otherwise required by law, the jury shall be composed of
4242 six members.
4343 (g) Jurors regularly impaneled for a week by the district
4444 court may, on request of the county judge or the judge of a county
4545 court at law, be made available and shall serve for the week in the
4646 county court or the county court at law.
4747 SECTION 2. Subsection (a), Section 152.0241, Human
4848 Resources Code, is amended to read as follows:
4949 (a) Bosque County is included in the Bosque, Comanche, and
5050 Hamilton counties juvenile board. The juvenile board is composed
5151 of:
5252 (1) the county judge in Bosque County;
5353 (2) the county judge in Comanche County;
5454 (3) the county judge in Hamilton County; [and]
5555 (4) the 220th Judicial District judge; and
5656 (5) the judge of the County Court at Law of Bosque
5757 County.
5858 SECTION 3. The County Court at Law of Bosque County is
5959 created October 1, 2009.
6060 SECTION 4. This Act takes effect October 1, 2009.
