| 6 | 6 | | relating to the names of persons included on a permit or license for |
|---|
| 7 | 7 | | certain solid waste facilities under the Solid Waste Disposal Act. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 361.003, Health and Safety Code, is |
|---|
| 10 | 10 | | amended by adding Subdivision (21-a) to read as follows: |
|---|
| 11 | 11 | | (21-a) "Operator" means the holder of the permit or |
|---|
| 12 | 12 | | license who is responsible for the overall operation of a solid |
|---|
| 13 | 13 | | waste facility. |
|---|
| 14 | 14 | | SECTION 2. Sections 361.087 and 361.157, Health and Safety |
|---|
| 15 | 15 | | Code, are amended to read as follows: |
|---|
| 16 | 16 | | Sec. 361.087. CONTENTS OF PERMIT. A permit issued under |
|---|
| 17 | 17 | | this subchapter must include: |
|---|
| 18 | 18 | | (1) the name and address of each person who owns the |
|---|
| 19 | 19 | | land on which the solid waste facility is located and the person who |
|---|
| 20 | 20 | | is or will be the operator [or person in charge of the facility]; |
|---|
| 21 | 21 | | (2) a legal description of the land on which the |
|---|
| 22 | 22 | | facility is located; and |
|---|
| 23 | 23 | | (3) the terms and conditions on which the permit is |
|---|
| 24 | 24 | | issued, including the duration of the permit. |
|---|
| 25 | 25 | | Sec. 361.157. CONTENTS OF LICENSE. A license for a solid |
|---|
| 26 | 26 | | waste facility issued by a county must include: |
|---|
| 27 | 27 | | (1) the name and address of each person who owns the |
|---|
| 28 | 28 | | land on which the solid waste facility is located and the person who |
|---|
| 29 | 29 | | is or will be the operator [or person in charge of the facility]; |
|---|
| 30 | 30 | | (2) a legal description of the land on which the |
|---|
| 31 | 31 | | facility is located; and |
|---|
| 32 | 32 | | (3) the terms and conditions on which the license is |
|---|
| 33 | 33 | | issued, including the duration of the license. |
|---|
| 34 | 34 | | SECTION 3. The changes in law to Sections 361.003, 361.087, |
|---|
| 35 | 35 | | and 361.157, Health and Safety Code, as amended by this Act, do not |
|---|
| 36 | 36 | | affect the status as of the effective date of this Act of any permit |
|---|
| 37 | 37 | | or license for, holder of a permit or license for, or owner or |
|---|
| 38 | 38 | | operator of a solid waste facility under Chapter 361, Health and |
|---|
| 39 | 39 | | Safety Code. The Texas Commission on Environmental Quality shall |
|---|
| 40 | 40 | | amend the commission's rules as necessary for the commission's |
|---|
| 41 | 41 | | permitting actions taken after the effective date of this Act to |
|---|
| 42 | 42 | | conform to those sections, as amended. |
|---|
| 43 | 43 | | SECTION 4. This Act takes effect September 1, 2009. |
