6 | 6 | | organizations established as part of the state's economic |

7 | 7 | | development program and of dependents of those employees to pay |
---|
8 | 8 | | resident tuition at public institutions of higher education. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 54.066, Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 54.066. ECONOMIC DEVELOPMENT AND DIVERSIFICATION. |
---|
13 | 13 | | (a) A person who registers at an institution of higher education |
---|
14 | 14 | | without having established resident status in this state under |
---|
15 | 15 | | Section 54.052 is entitled to pay tuition and required fees at the |
---|
16 | 16 | | rate provided for residents of this state if: |
---|
17 | 17 | | (1) the person or, as determined by coordinating board |
---|
18 | 18 | | rule, an adult member of the person's family who resides in the |
---|
19 | 19 | | person's household and is a primary caretaker of the person |
---|
20 | 20 | | establishes by the institution's enrollment date a residence in |
---|
21 | 21 | | this state as a result of the person's or caretaker's employment by |
---|
22 | 22 | | a business or organization that, not earlier than five years before |
---|
23 | 23 | | the enrollment date, became established in this state as part of the |
---|
24 | 24 | | program of state economic development and diversification |
---|
25 | 25 | | authorized by the law of this state; and |
---|
26 | 26 | | (2) the person files with that institution of higher |
---|
27 | 27 | | education a letter of intent to establish residency in this state. |
---|
28 | 28 | | (b) The Texas Higher Education Coordinating Board, in |
---|
29 | 29 | | consultation with the Texas Economic Development and Tourism |
---|
30 | 30 | | Office, shall establish procedures to determine: |
---|
31 | 31 | | (1) whether a business or organization meets the |
---|
32 | 32 | | requirements of this section; and |
---|
33 | 33 | | (2) the date on which the business or organization |
---|
34 | 34 | | became established in this state as part of the program of state |
---|
35 | 35 | | economic development and diversification. |
---|
36 | 36 | | SECTION 2. The change in law made by this Act to Section |
---|
37 | 37 | | 54.066, Education Code, applies beginning with tuition and required |
---|
38 | 38 | | fees for the fall 2010 semester. Tuition and fees for a semester or |
---|
39 | 39 | | other academic term before that semester are covered by the law in |
---|
40 | 40 | | effect immediately before the effective date of this Act, and the |
---|
41 | 41 | | former law is continued in effect for that purpose. |
---|
42 | 42 | | SECTION 3. This Act takes effect January 1, 2010. |
