| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2101.011, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (e) to read as follows: |
|---|
| 12 | 12 | | (e) A university system or an institution of higher |
|---|
| 13 | 13 | | education as those terms are defined by Section 61.003, Education |
|---|
| 14 | 14 | | Code, may submit a comprehensive annual financial statement |
|---|
| 15 | 15 | | prepared to comply with generally accepted accounting and reporting |
|---|
| 16 | 16 | | standards applicable to institutions of higher education in place |
|---|
| 17 | 17 | | of the annual financial statement required by this section. |
|---|
| 18 | 18 | | SECTION 2. Section 2101.0115, Government Code, is amended |
|---|
| 19 | 19 | | by adding Subsection (e) to read as follows: |
|---|
| 20 | 20 | | (e) This section does not apply to a university system or an |
|---|
| 21 | 21 | | institution of higher education as those terms are defined by |
|---|
| 22 | 22 | | Section 61.003, Education Code. |
|---|
| 23 | 23 | | SECTION 3. Section 412.042, Labor Code, is amended by |
|---|
| 24 | 24 | | adding Subsection (d) to read as follows: |
|---|
| 25 | 25 | | (d) Subsection (c) does not apply to a university system or |
|---|
| 26 | 26 | | an institution of higher education as those terms are defined by |
|---|
| 27 | 27 | | Section 61.003, Education Code. |
|---|
| 28 | 28 | | SECTION 4. Sections 33.083(d) and 61.0582, Education Code, |
|---|
| 29 | 29 | | are repealed. |
|---|
| 30 | 30 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
