| 6 | 6 | | relating to the exercise of urban renewal powers by certain |

| 7 | 7 | | counties. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 374.902(b), Local Government Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (b) A county with a population of more than 193,000 [1.3 |
|---|
| 12 | 12 | | million] may exercise the powers provided for municipalities under |
|---|
| 13 | 13 | | this chapter with respect to areas of the county that are not within |
|---|
| 14 | 14 | | the corporate boundaries of a municipality. The county may not |
|---|
| 15 | 15 | | exercise those powers until the commissioners court of the county |
|---|
| 16 | 16 | | adopts a resolution in the manner provided by Section 374.011 for |
|---|
| 17 | 17 | | adoption of a resolution by a municipality. The resolution must be |
|---|
| 18 | 18 | | approved at an election held in the county in the manner provided |
|---|
| 19 | 19 | | for a municipal election under Section 374.011. The adoption of the |
|---|
| 20 | 20 | | resolution is not approved unless a majority of the voters who vote |
|---|
| 21 | 21 | | on the question in the entire county as well as in each municipality |
|---|
| 22 | 22 | | in the county approve the adoption of the resolution. In a |
|---|
| 23 | 23 | | municipality that is only partially located in the affected county, |
|---|
| 24 | 24 | | only voters who reside in the county may vote. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
