55 AN ACT
66 relating to the exercise of urban renewal powers by certain
77 counties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 374.902(b), Local Government Code, is
1010 amended to read as follows:
1111 (b) A county with a population of more than 193,000 [1.3
1212 million] may exercise the powers provided for municipalities under
1313 this chapter with respect to areas of the county that are not within
1414 the corporate boundaries of a municipality. The county may not
1515 exercise those powers until the commissioners court of the county
1616 adopts a resolution in the manner provided by Section 374.011 for
1717 adoption of a resolution by a municipality. The resolution must be
1818 approved at an election held in the county in the manner provided
1919 for a municipal election under Section 374.011. The adoption of the
2020 resolution is not approved unless a majority of the voters who vote
2121 on the question in the entire county as well as in each municipality
2222 in the county approve the adoption of the resolution. In a
2323 municipality that is only partially located in the affected county,
2424 only voters who reside in the county may vote.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2009.
