66 AN ACT
77 relating to the determination of resident status of students by
88 public institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 54.052, Education Code, is amended to
1111 read as follows:
1212 Sec. 54.052. DETERMINATION OF RESIDENT STATUS.
1313 (a) Subject to the other applicable provisions of this subchapter
1414 governing the determination of resident status, the following
1515 persons are considered residents of this state for purposes of this
1616 title:
1717 (1) except as provided by Subsections (c) and (d), a
1818 person who:
1919 (A) established a domicile in this state not
2020 later than one year before the census date of the academic term in
2121 which the person is enrolled in an institution of higher education;
2222 and
2323 (B) maintained that domicile continuously for
2424 the year preceding that census date;
2525 (2) except as provided by Subsections (c) and (d), a
2626 dependent whose parent:
2727 (A) established a domicile in this state not
2828 later than one year before the census date of the academic term in
2929 which the dependent is enrolled in an institution of higher
3030 education; and
3131 (B) maintained that domicile continuously for
3232 the year preceding that census date; and
3333 (3) a person who:
3434 (A) graduated from a public or private high
3535 school in this state or received the equivalent of a high school
3636 diploma in this state; and
3737 (B) maintained a residence continuously in this
3838 state for:
3939 (i) the three years preceding the date of
4040 graduation or receipt of the diploma equivalent, as applicable; and
4141 (ii) the year preceding the census date of
4242 the academic term in which the person is enrolled in an institution
4343 of higher education.
4444 (b) For purposes of this section, except as provided by
4545 Subsections (c) and (d), the domicile of a dependent's parent is
4646 presumed to be the domicile of the dependent unless the person
4747 establishes eligibility for resident status under Subsection
4848 (a)(3).
4949 (c) A person who, when not a resident of this state, moves to
5050 this state and establishes a residence in this state primarily to
5151 enroll at an institution of higher education is presumed not to have
5252 established a domicile in this state, regardless of whether the
5353 person is a dependent of a parent with domicile in this state when
5454 the person moves to this state.
5555 (d) A person described by Subsection (c) may rebut the
5656 presumption under Subsection (c) by establishing that the person,
5757 or a parent of the person with domicile in this state and of whom the
5858 person is a dependent:
5959 (1) purchased real property in this state not later
6060 than one year before the census date of the academic term for which
6161 the person claims status as a resident of this state;
6262 (2) for a period of at least one year before the census
6363 date of the academic term for which the person claims status as a
6464 resident of this state:
6565 (A) was gainfully employed in this state, other
6666 than by a public or private institution of higher education in this
6767 state in a position requiring enrollment at that institution or at
6868 another public or private institution of higher education in this
6969 state;
7070 (B) had an ownership interest in a business or
7171 other commercial enterprise in this state;
7272 (C) held a state or local license to conduct a
7373 business or practice a profession in this state; or
7474 (D) received services as a homeless person from a
7575 social service agency that provides services to such persons in
7676 this state; or
7777 (3) engaged in any other conduct or activity the
7878 coordinating board determines by rule indicates a bona fide
7979 domicile in this state.
8080 SECTION 2. Section 54.053, Education Code, is amended to
8181 read as follows:
8282 Sec. 54.053. INFORMATION REQUIRED TO ESTABLISH RESIDENT
8383 STATUS. A person shall submit the following information to an
8484 institution of higher education to establish resident status under
8585 this subchapter:
8686 (1) if the person applies for resident status under
8787 Section 54.052(a)(1):
8888 (A) a statement of the dates and length of time
8989 the person has resided in this state, as relevant to establish
9090 resident status under this subchapter; [and]
9191 (B) a statement by the person that the person's
9292 presence in this state for that period was for a purpose of
9393 establishing and maintaining a domicile in this state; and
9494 (C) if appropriate, evidence sufficient under
9595 Section 54.052(d) to rebut the presumption under Section 54.052(c)
9696 that the person has not established a domicile in this state;
9797 (2) if the person applies for resident status under
9898 Section 54.052(a)(2):
9999 (A) a statement of the dates and length of time
100100 any parent of the person has resided in this state, as relevant to
101101 establish resident status under this subchapter; [and]
102102 (B) a statement by the parent or, if the parent is
103103 unable or unwilling to provide the statement, a statement by the
104104 person that the parent's presence in this state for that period was
105105 for a purpose of establishing and maintaining a domicile in this
106106 state; and
107107 (C) if appropriate, evidence sufficient under
108108 Section 54.052(d) to rebut the presumption under Section 54.052(c)
109109 that the person has not established a domicile in this state; or
110110 (3) if the person applies for resident status under
111111 Section 54.052(a)(3):
112112 (A) a statement of the dates and length of time
113113 the person has resided in this state, as relevant to establish
114114 resident status under this subchapter; and
115115 (B) if the person is not a citizen or permanent
116116 resident of the United States, an affidavit stating that the person
117117 will apply to become a permanent resident of the United States as
118118 soon as the person becomes eligible to apply.
119119 SECTION 3. Notwithstanding Subchapter B, Chapter 54,
120120 Education Code, a public institution of higher education in this
121121 state may, for any semester or academic term, before the beginning
122122 of that semester or academic term, reclassify as a nonresident a
123123 student classified as a resident of this state by the institution or
124124 another public institution of higher education in this state under
125125 Section 54.052(a), Education Code, as that section existed before
126126 amendment by this Act, if the student is not otherwise eligible to
127127 be classified as a resident of this state under Subchapter B,
128128 Chapter 54, Education Code.
129129 SECTION 4. This Act takes effect September 1, 2009.
