9	9	AN ACT
10	10	relating to standards for installing fire hydrants in certain
11	11	residential areas.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subsection (b), Section 341.0357, Health and
14	14	Safety Code, as added by Chapter 861 (H.B. 1391), Acts of the 80th
15	15	Legislature, Regular Session, 2007, is amended to read as follows:
16	16	(b) The regulatory authority for a public utility shall by
17	17	rule or ordinance adopt standards for installing fire hydrants and
18	18	maintaining sufficient water pressure for service to fire hydrants
19	19	adequate to protect public safety in residential areas in a
20	20	municipality with a population of 1,000,000 or more.
21	21	SECTION 2. Subsection (b), Section 341.0358, Health and
22	22	Safety Code, is amended to read as follows:
23	23	(b) The regulatory authority for a public utility shall by
24	24	rule or ordinance adopt standards for installing fire hydrants and
25	25	maintaining sufficient water pressure for service to fire hydrants
26	26	adequate to protect public safety in residential areas in a
27	27	municipality with a population of 1,000,000 or more.
28	28	SECTION 3. (a) Section 1 of this Act takes effect only if
29	29	the Act of the 81st Legislature, Regular Session, 2009, relating to
30	30	nonsubstantive additions to and corrections in existing codes
31	31	(H.B. No. 3545 or S.B. No. 1969) does not become law. If the Act of
32	32	the 81st Legislature, Regular Session, 2009, relating to
33	33	nonsubstantive additions to and corrections in existing codes
34	34	(H.B. No. 3545 or S.B. No. 1969) becomes law, Section 1 of this Act
35	35	has no effect.
36	36	(b) Section 2 of this Act takes effect only if the Act of the
37	37	81st Legislature, Regular Session, 2009, relating to
38	38	nonsubstantive additions to and corrections in existing codes
39	39	(H.B. No. 3545 or S.B. No. 1969) becomes law. If the Act of the
40	40	81st Legislature, Regular Session, 2009, relating to
41	41	nonsubstantive additions to and corrections in existing codes
42	42	(H.B. No. 3545 or S.B. No. 1969) does not become law, Section 2 of
43	43	this Act has no effect.
44	44	SECTION 4. This Act takes effect September 1, 2009.
