A BILL TO BE ENTITLED
AN ACT
relating to a fee on certain lottery prizes to fund the TEXAS grant
program.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter I, Chapter 466, Government Code, is
amended by adding Section 466.4055 to read as follows:
Sec. 466.4055. PRIZE FEE. (a) The director shall collect
from a person who is paid a prize of $600 or more a fee in the amount
of five percent of the amount of the prize.
(b) Fees collected under this section shall be deposited to
the credit of the general revenue fund and may be appropriated only
to fund the TEXAS grant program administered under Subchapter M,
Chapter 56, Education Code.
SECTION 2. Section 466.4055, Government Code, as added by
this Act, applies only to a lottery prize paid by the director of
the lottery division of the Texas Lottery Commission on or after the
effective date of this Act.
SECTION 3. This Act takes effect September 1, 2009.
