6 | 6 | | relating to certain reporting duties of the attorney general and |
---|
7 | 7 | | the Department of Aging and Disability Service. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subsections (a) and (c), Section 242.005, Health |
---|
10 | 10 | | and Safety Code, are amended to read as follows: |
---|
11 | 11 | | (a) The department [and the attorney general each] shall |
---|
12 | 12 | | prepare annually a full report of the operation and administration |
---|
13 | 13 | | of the department's [their respective] responsibilities under this |
---|
14 | 14 | | chapter, including recommendations and suggestions considered |
---|
15 | 15 | | advisable. |
---|
16 | 16 | | (c) The department [and the attorney general] shall submit |
---|
17 | 17 | | the required report [reports] to the governor and the legislature |
---|
18 | 18 | | not later than January 31 [October 1] of each year. |
---|
19 | 19 | | SECTION 2. Subsections (a) and (c), Section 247.050, Health |
---|
20 | 20 | | and Safety Code, are amended to read as follows: |
---|
21 | 21 | | (a) The executive commissioner of the Health and Human |
---|
22 | 22 | | Services Commission [board] shall adopt procedures to monitor the |
---|
23 | 23 | | status of unlicensed assisted living facilities. As part of these |
---|
24 | 24 | | procedures, the department shall: |
---|
25 | 25 | | (1) maintain a registry of all reported unlicensed |
---|
26 | 26 | | assisted living facilities for the purpose of periodic follow-up by |
---|
27 | 27 | | the field staff in each region; and |
---|
28 | 28 | | (2) prepare an annual [a quarterly] report that shows |
---|
29 | 29 | | the number of: |
---|
30 | 30 | | (A) complaints relating to unlicensed assisted |
---|
31 | 31 | | living facilities that are received; |
---|
32 | 32 | | (B) complaints that are investigated; |
---|
33 | 33 | | (C) unsubstantiated complaints; |
---|
34 | 34 | | (D) substantiated complaints; and |
---|
35 | 35 | | (E) cases referred to the attorney general. |
---|
36 | 36 | | (c) The department [and the attorney general] shall file a |
---|
37 | 37 | | copy of the annual report [quarterly reports] required by this |
---|
38 | 38 | | section with the substantive committees of each house of the |
---|
39 | 39 | | legislature with jurisdiction over regulation of assisted living |
---|
40 | 40 | | facilities. |
---|
41 | 41 | | SECTION 3. Subsection (c), Section 61.0815, Education Code, |
---|
42 | 42 | | is amended to read as follows: |
---|
43 | 43 | | (c) The [attorney general and the] president of each |
---|
44 | 44 | | institution of higher education shall collect all necessary data |
---|
45 | 45 | | for inclusion in the report required by this section. |
---|
46 | 46 | | SECTION 4. The following provisions are repealed: |
---|
47 | 47 | | (1) Section 2107.005, Government Code; |
---|
48 | 48 | | (2) Subsection (b), Section 247.050, Health and Safety |
---|
49 | 49 | | Code; and |
---|
50 | 50 | | (3) Section 240.903, Local Government Code. |
---|
51 | 51 | | SECTION 5. This Act takes effect immediately if it receives |
---|
52 | 52 | | a vote of two-thirds of all the members elected to each house, as |
---|
53 | 53 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
54 | 54 | | Act does not receive the vote necessary for immediate effect, this |
---|
55 | 55 | | Act takes effect September 1, 2009. |
