55 AN ACT
66 Related to parole board rules regarding inmates claiming actual
77 innocence.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 508.0441, Government Code, is amended to
1010 read as follows:
1111 (d) The parole board may not adopt any rule, policy or
1212 practice that penalizes or denies privileges to a prisoner for
1313 failing to take responsibility for the crime for which they were
1414 incarcerated or other offenses for which the prisoner has not been
1515 finally convicted if that prisoner maintained innocence at trial
1616 and throughout the post-conviction appellate process, including
1717 any post-conviction habeas writs.
1818 (e) The presiding officer may provide a written plan for the
1919 administrative review of actions taken by a parole panel by a review
2020 panel.
2121 (f) Board members and parole commissioners shall, at the
2222 direction of the presiding officer, file activity reports on duties
2323 performed under this chapter.
2424 SECTION 2. This Act takes effect September 1, 2009.
