| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter K, Chapter 17, Water Code, is amended |
|---|
| 11 | 11 | | by adding Section 17.9225 to read as follows: |
|---|
| 12 | 12 | | Sec. 17.9225. RESIDENTIAL WATER AND SEWER CONNECTION |
|---|
| 13 | 13 | | ASSISTANCE. (a) The legislature finds that, due to public health |
|---|
| 14 | 14 | | and sanitation concerns, it is in the public interest to use funds |
|---|
| 15 | 15 | | in the economically distressed areas account to provide financial |
|---|
| 16 | 16 | | assistance for the costs associated with the initial connection to |
|---|
| 17 | 17 | | public water supply and sanitary sewer systems of residences that |
|---|
| 18 | 18 | | otherwise benefit from financial assistance. |
|---|
| 19 | 19 | | (b) A political subdivision may use financial assistance to |
|---|
| 20 | 20 | | pay: |
|---|
| 21 | 21 | | (1) the costs of connecting a residence to a public |
|---|
| 22 | 22 | | water supply system constructed with financial assistance; |
|---|
| 23 | 23 | | (2) the costs of installing yard water service |
|---|
| 24 | 24 | | connections; |
|---|
| 25 | 25 | | (3) the costs of installing indoor plumbing facilities |
|---|
| 26 | 26 | | and fixtures; |
|---|
| 27 | 27 | | (4) the costs of connecting a residence to a sanitary |
|---|
| 28 | 28 | | sewer system constructed with financial assistance; |
|---|
| 29 | 29 | | (5) necessary connection and permit fees; and |
|---|
| 30 | 30 | | (6) necessary costs related to the design of plumbing |
|---|
| 31 | 31 | | improvements described by this subsection. |
|---|
| 32 | 32 | | (c) Assistance under this section shall only be provided to |
|---|
| 33 | 33 | | residents who demonstrate an inability to pay for the improvements |
|---|
| 34 | 34 | | described in Subsection (b) in accordance with board rules. The |
|---|
| 35 | 35 | | board shall adopt rules to implement the provisions of this |
|---|
| 36 | 36 | | section. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect September 1, 2009. |
