77 relating to providing housing assistance to rural communities and
88 small municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2306.0521(b), Government Code, is
1111 amended to read as follows:
1212 (b) This section does not apply to:
1313 (1) the manufactured housing division; or
1414 (2) the division for rural community and small
1515 municipality housing initiatives established by Section 2306.302.
1616 SECTION 2. Section 2306.253, Government Code, is amended by
1717 adding Subsections (a-1) and (a-2) to read as follows:
1818 (a-1) In addition to the education program implemented
1919 under Subsection (a), the department shall develop and implement a
2020 homebuyer education program designed to provide information and
2121 counseling to individuals and families of low income in rural
2222 communities and small municipalities. The education program must
2323 address topics relating to:
2424 (1) the home buying process;
2525 (2) financial literacy;
2626 (3) foreclosure remediation; and
2727 (4) other programs determined by the department as
2828 necessary to increase home ownership by individuals and families of
2929 low income.
3030 (a-2) The department may require any person who receives
3131 mortgage-based financial assistance from the department to
3232 complete the homebuyer education program established by Subsection
3333 (a-1).
3434 SECTION 3. Chapter 2306, Government Code, is amended by
3535 adding Subchapter N to read as follows:
3636 SUBCHAPTER N. RURAL COMMUNITY AND SMALL MUNICIPALITY
3737 HOUSING INITIATIVES
3838 Sec. 2306.301. DEFINITION. In this subchapter, "division"
3939 means the division established by Section 2306.302 to support rural
4040 community and small municipality housing initiatives.
4141 Sec. 2306.302. ESTABLISHMENT OF DIVISION. (a) The
4242 department shall establish a division to support rural community
4343 and small municipality housing initiatives.
4444 (b) The department by rule shall define:
4545 (1) a small municipality; and
4646 (2) a rural community.
4747 Sec. 2306.303. REGIONAL HOUSING DEVELOPMENT ORGANIZATIONS.
4848 (a) The division shall establish regional nonprofit housing
4949 development organizations that serve rural communities and small
5050 municipalities in accordance with the purposes of this subchapter.
5151 (b) To implement this section, the department may use any
5252 money available to the department for the purpose, including
5353 legislative appropriations and gifts, grants, and donations.
5454 (c) The division may use the services of the Texas State
5555 Affordable Housing Corporation when necessary to accomplish the
5656 purposes of this section.
5757 Sec. 2306.304. TRAINING. The division annually shall
5858 provide to elected officials, community organizations, nonprofit
5959 organizations, and private developers a training course that
6060 addresses housing programs and techniques that increase housing
6161 opportunities in rural communities and small municipalities. The
6262 division shall provide the course at an appropriate location
6363 selected by the division and shall make the course available online
6464 in real time.
6565 Sec. 2306.305. RURAL GRANTS ADMINISTRATOR. (a) The
6666 director shall designate a rural grants administrator within the
6767 division established by Section 2306.302.
6868 (b) The rural grants administrator shall:
6969 (1) oversee and coordinate division initiatives that
7070 are directed toward specific rural communities or small
7171 municipalities; and
7272 (2) provide information to the director and the board
7373 regarding the impact of proposed department programs, rules, and
7474 initiatives on housing opportunities in rural communities and small
7575 municipalities.
7676 Sec. 2306.306. HOUSING DEVELOPMENT PLANNING ASSISTANCE. On
7777 the request of the governing body of a municipality or county, the
7878 division shall assign a department employee or independent
7979 contractor to assist the municipality or county in:
8080 (1) developing comprehensive housing plans for rural
8181 communities and small municipalities in that county;
8282 (2) supporting housing development initiatives in
8383 those communities and municipalities; and
8484 (3) identifying financial resources available for
8585 those plans and initiatives.
8686 Sec. 2306.307. RURAL COMMUNITY AND SMALL MUNICIPALITY
8787 HOUSING DEVELOPMENT PILOT PROJECTS. Notwithstanding other program
8888 rules and procedures of the department, the division may establish
8989 pilot projects to test and develop new approaches to providing
9090 housing in rural communities and small municipalities for:
9191 (1) individuals and families of low income;
9292 (2) individuals and families of very low income; or
9393 (3) agricultural workers.
9494 Sec. 2306.308. AGRICULTURAL WORKER HOUSING INITIATIVE. (a)
9595 The division shall fund housing initiatives that serve agricultural
9696 workers, including:
9797 (1) new housing initiatives;
9898 (2) housing rehabilitation initiatives; or
9999 (3) tenant-based rental assistance.
100100 (b) The division may designate a housing initiative for
101101 agricultural workers as a pilot project authorized under Section
102102 2306.307.
103103 (c) The division shall coordinate with other appropriate
104104 divisions of the department to:
105105 (1) document agricultural worker housing needs;
106106 (2) determine whether a housing need documented by the
107107 department is critical; and
108108 (3) develop initiatives to address those housing
109109 needs.
110110 (d) The division may use any available funds to implement
111111 this section, including legislative appropriations and gifts,
112112 grants, and donations.
113113 Sec. 2306.309. RURAL LAND BANK DEMONSTRATION PROGRAM. (a)
114114 The department may adopt a rural land bank demonstration program,
115115 or may enter into a memorandum of understanding requiring the Texas
116116 State Affordable Housing Corporation to adopt a rural land bank
117117 demonstration program, in which the officer charged with selling
118118 real property ordered sold pursuant to foreclosure of a tax lien may
119119 sell certain eligible real property by private sale for purposes of
120120 affordable housing development as provided by department rule.
121121 (b) The department may adopt any rules necessary for the
122122 purposes of the program, including a rule to establish or approve a
123123 land bank for the purpose of acquiring, holding, and transferring
124124 unimproved real property under this section.
125125 SECTION 4. (a) Not later than December 1, 2009, the Texas
126126 Department of Housing and Community Affairs shall implement the
127127 homebuyer education program required by Section 2306.253(a-1),
128128 Government Code, as added by this Act.
129129 (b) Not later than October 1, 2009, the Texas Department of
130130 Housing and Community Affairs shall adopt the rules required by
131131 Subchapter N, Chapter 2306, Government Code, as added by this Act.
132132 SECTION 5. This Act takes effect September 1, 2009.
