55 AN ACT
66 relating to the use of discretionary funds raised by public school
77 campuses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter Z, Chapter 44, Education Code, is
1010 amended by adding Section 44.908 to read as follows:
1111 Sec. 44.908. USE OF CAMPUS DISCRETIONARY FUNDS. (a) In
1212 this section, "campus discretionary funds" means money raised at a
1313 public school campus through vending machines or other sources
1414 specifically associated with the campus.
1515 (b) Campus discretionary funds may be used only to:
1616 (1) directly benefit the general welfare and
1717 educational development and morale of students enrolled at the
1818 campus; or
1919 (2) provide professional development for campus
2020 educators, including teachers, administrators, counselors, and
2121 librarians, that:
2222 (A) deepens and broadens knowledge of content;
2323 (B) provides a strong foundation in the pedagogy
2424 of particular disciplines;
2525 (C) provides knowledge about the teaching and
2626 learning processes;
2727 (D) is based on and reflects the best available
2828 research;
2929 (E) is aligned with the standards and curriculum
3030 used in the school district;
3131 (F) contributes to measurable improvement in
3232 student achievement;
3333 (G) deepens and broadens knowledge and
3434 understanding of strategies needed to promote college and career
3535 readiness; and
3636 (H) provides opportunities to build proficiency
3737 in data-driven decision-making.
3838 (c) Subject to Subsection (b), the board of trustees of the
3939 district has authority over the specific use of campus
4040 discretionary funds.
4141 SECTION 2. Section 44.908, Education Code, as added by this
4242 Act, applies to any expenditure of campus discretionary funds that
4343 occurs on or after the effective date of this Act, regardless of the
4444 date on which the funds were raised.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2009.
