| 6 | 6 | | relating to the use of discretionary funds raised by public school |

| 7 | 7 | | campuses. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter Z, Chapter 44, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 44.908 to read as follows: |
|---|
| 11 | 11 | | Sec. 44.908. USE OF CAMPUS DISCRETIONARY FUNDS. (a) In |
|---|
| 12 | 12 | | this section, "campus discretionary funds" means money raised at a |
|---|
| 13 | 13 | | public school campus through vending machines or other sources |
|---|
| 14 | 14 | | specifically associated with the campus. |
|---|
| 15 | 15 | | (b) Campus discretionary funds may be used only to: |
|---|
| 16 | 16 | | (1) directly benefit the general welfare and |
|---|
| 17 | 17 | | educational development and morale of students enrolled at the |
|---|
| 18 | 18 | | campus; or |
|---|
| 19 | 19 | | (2) provide professional development for campus |
|---|
| 20 | 20 | | educators, including teachers, administrators, counselors, and |
|---|
| 21 | 21 | | librarians, that: |
|---|
| 22 | 22 | | (A) deepens and broadens knowledge of content; |
|---|
| 23 | 23 | | (B) provides a strong foundation in the pedagogy |
|---|
| 24 | 24 | | of particular disciplines; |
|---|
| 25 | 25 | | (C) provides knowledge about the teaching and |
|---|
| 26 | 26 | | learning processes; |
|---|
| 27 | 27 | | (D) is based on and reflects the best available |
|---|
| 28 | 28 | | research; |
|---|
| 29 | 29 | | (E) is aligned with the standards and curriculum |
|---|
| 30 | 30 | | used in the school district; |
|---|
| 31 | 31 | | (F) contributes to measurable improvement in |
|---|
| 32 | 32 | | student achievement; |
|---|
| 33 | 33 | | (G) deepens and broadens knowledge and |
|---|
| 34 | 34 | | understanding of strategies needed to promote college and career |
|---|
| 35 | 35 | | readiness; and |
|---|
| 36 | 36 | | (H) provides opportunities to build proficiency |
|---|
| 37 | 37 | | in data-driven decision-making. |
|---|
| 38 | 38 | | (c) Subject to Subsection (b), the board of trustees of the |
|---|
| 39 | 39 | | district has authority over the specific use of campus |
|---|
| 40 | 40 | | discretionary funds. |
|---|
| 41 | 41 | | SECTION 2. Section 44.908, Education Code, as added by this |
|---|
| 42 | 42 | | Act, applies to any expenditure of campus discretionary funds that |
|---|
| 43 | 43 | | occurs on or after the effective date of this Act, regardless of the |
|---|
| 44 | 44 | | date on which the funds were raised. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2009. |
