8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 16.0121, Water Code, is amended by | |
10 | 10 | amending Subsection (b) and adding Subsection (g) to read as | |
11 | 11 | follows: | |
12 | 12 | (b) Except as provided by Subsection (g) [Every five years], | |
13 | 13 | a retail public utility providing potable water shall perform and | |
14 | 14 | file with the board, every five years, a water audit computing the | |
15 | 15 | utility's most recent annual system water loss. | |
16 | 16 | (g) A retail public utility shall perform and file with the | |
17 | 17 | board a water loss audit annually if the utility is receiving any | |
18 | 18 | financial assistance from the board. | |
19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect September 1, 2009. |
