| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 33.032, Government Code, is amended by | |
| 11 | 11 | adding Subsection (i) to read as follows: | |
| 12 | 12 | (i) The discussions, thought processes, or individual votes | |
| 13 | 13 | of members of the commission, the discussions or thought processes | |
| 14 | 14 | of employees of the commission, including special counsel for the | |
| 15 | 15 | commission, and the identity of a confidential complainant or | |
| 16 | 16 | informant are confidential and privileged unless expressly waived, | |
| 17 | 17 | in writing, by the commission or, in the case of a confidential | |
| 18 | 18 | complainant or informant, by that individual or the legal | |
| 19 | 19 | representative of the individual. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2009. |
