44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to maintaining county funding levels provided to the
77 offices of certain prosecutors.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 46.006(b), Government Code, is amended
1010 to read as follows:
1111 (b) The commissioners court in each county that has a
1212 prosecutor subject to this chapter and that has a population of over
1313 two million persons may not reduce the county funds provided for the
1414 salary or office of the prosecutor [as a result of the funds
1515 provided by this chapter] below the amount provided for that salary
1616 or office in the county budget for the previous year, except as
1717 authorized by a majority of the qualified voters of the county
1818 voting on the question in a referendum held by the county as
1919 provided by this section and other applicable law.
2020 SECTION 2. Section 46.006, Government Code, is amended by
2121 adding new subsections (c), (d) to read as follows:
2222 (c) In a referendum required by this section, the ballot
2323 shall be printed to provide for voting for or against the
2424 proposition, as appropriate:
2525 (1) "Reduction of county funds for the office of
2626 district attorney";
2727 (2) "Reduction of county funds for the office of
2828 county attorney"; or
2929 (3) "Reduction of county funds for the office of
3030 criminal district attorney".
3131 (d) A referendum under this section must be held on an
3232 authorized uniform election date as provided by Chapter 41,
3333 Election Code.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2009.
