66 AN ACT
77 relating to authorizing individuals to leave certain permitted
88 premises and other areas with alcoholic beverages.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 28, Alcoholic Beverage Code, is amended
1111 by adding Section 28.101 to read as follows:
1212 Sec. 28.101. PUBLIC CONSUMPTION. (a) This section applies
1313 only to a mixed beverage permit holder whose premises are located in
1414 a municipality that:
1515 (1) has a population of less than 10,000;
1616 (2) is located in a county with a population of less
1717 than 50,000; and
1818 (3) contains a historic preservation district that
1919 borders a lake.
2020 (b) Notwithstanding Section 28.10 or any other law, the
2121 holder of a mixed beverage permit whose permitted premises are
2222 located in a historic preservation district or a historic
2323 compatibility district adjacent to a historic preservation
2424 district may permit a patron to leave the permitted premises, even
2525 though the patron possesses an alcoholic beverage, if:
2626 (1) the beverage is in an open container and appears to
2727 be possessed for present consumption; and
2828 (2) the public consumption of alcoholic beverages or
2929 possession of an open container of an alcoholic beverage is not
3030 prohibited in the historic preservation district or historic
3131 compatibility district where the permitted premises are located.
3232 (c) This section does not affect the prohibition against
3333 possessing an open container in a passenger area of a motor vehicle
3434 under Section 49.031, Penal Code.
3535 SECTION 2. Chapter 31, Alcoholic Beverage Code, is amended
3636 by adding Section 31.06 to read as follows:
3737 Sec. 31.06. PUBLIC CONSUMPTION. (a) This section applies
3838 only to the holder of a caterer's permit operating under the permit
3939 in an area in a municipality that:
4040 (1) has a population of less than 10,000;
4141 (2) is located in a county with a population of less
4242 than 50,000; and
4343 (3) contains a historic preservation district that
4444 borders a lake.
4545 (b) Notwithstanding any other law, the holder of a caterer's
4646 permit operating under the permit in an area located in a historic
4747 preservation district or a historic compatibility district
4848 adjacent to a historic preservation district may permit a patron to
4949 leave the area, even though the patron possesses an alcoholic
5050 beverage, if:
5151 (1) the beverage is in an open container and appears to
5252 be possessed for present consumption; and
5353 (2) the public consumption of alcoholic beverages or
5454 possession of an open container of an alcoholic beverage is not
5555 prohibited in the historic preservation district or historic
5656 compatibility district where the area is located.
5757 (c) This section does not affect the prohibition against
5858 possessing an open container in a passenger area of a motor vehicle
5959 under Section 49.031, Penal Code.
6060 SECTION 3. This Act takes effect September 1, 2009.
