6	6	AN ACT
7	7	relating to the salary paid to certain professional employees of
8	8	public schools.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 21.402, Education Code, is amended by
11	11	amending Subsections (c) and (d) and adding Subsection (c-1) to
12	12	read as follows:

32	32	(c-1) Notwithstanding Subsection (a), a classroom teacher,
33	33	full-time librarian, full-time counselor certified under
34	34	Subchapter B, or full-time school nurse is entitled to a monthly
35	35	salary that is at least equal to the sum of:
36	36	(1) the monthly salary the employee would have
37	37	received for the current school year under the district's salary
38	38	schedule for the 2008-2009 school year, if that schedule had been in
39	39	effect for the current school year, including any local supplement
40	40	and any money representing a career ladder supplement the employee
41	41	would have received in the current school year; and
42	42	(2) the following applicable amount, depending on the
43	43	employee's years of experience:
44	44	(A) $200, if the employee has less than six years
45	45	of experience;
46	46	(B) $300, if the employee has at least six but
47	47	less than 11 years of experience;
48	48	(C) $400, if the employee has at least 11 but less
49	49	than 16 years of experience; or
50	50	(D) $500, if the employee has at least 16 years of
51	51	experience.
52	52	(d) A classroom teacher, full-time librarian, full-time
53	53	counselor certified under Subchapter B, or full-time school nurse
54	54	employed by a school district in the 2009-2010 [2006-2007] school
55	55	year is, as long as the employee is employed by the same district,
56	56	entitled to a salary that is at least equal to the salary the
57	57	employee received for the 2009-2010 [2006-2007] school year.
58	58	SECTION 2. Section 42.2516, Education Code, is amended by
59	59	adding Subsection (e-1) to read as follows:
60	60	(e-1) The amount of state aid or credit to which a school
61	61	district is entitled under Section 42.2518 is in addition to the
62	62	amount of revenue to which the district is entitled under
63	63	Subsection (b).
64	64	SECTION 3. Subchapter E, Chapter 42, Education Code, is
65	65	amended by adding Section 42.2518 to read as follows:
66	66	Sec. 42.2518. ADDITIONAL STATE AID OR CREDIT AGAINST COST
67	67	OF ATTENDANCE CREDITS FOR PROFESSIONAL STAFF SALARIES. (a) A
68	68	school district, including a school district that is otherwise
69	69	ineligible for state aid under this chapter, is entitled to state
70	70	aid in an amount, as determined by the commissioner, equal to the
71	71	sum of the following amounts, as determined by the number of
72	72	classroom teachers, full-time librarians, full-time counselors
73	73	certified under Subchapter B, Chapter 21, and full-time school
74	74	nurses employed by the district and entitled to a minimum salary
75	75	under Section 21.402:
76	76	(1) $2,000 multiplied by the number of eligible
77	77	employees with less than six years of experience;
78	78	(2) $3,000 multiplied by the number of eligible
79	79	employees with at least six but less than 11 years of experience;
80	80	(3) $4,000 multiplied by the number of eligible
81	81	employees with at least 11 but less than 16 years of experience; and
82	82	(4) $5,000 multiplied by the number of eligible
83	83	employees with at least 16 years of experience.
84	84	(b) A school district that is required to take action under
85	85	Chapter 41 to reduce its wealth per student to the equalized wealth
86	86	level is entitled to a credit, in the amount of state aid to which
87	87	the district is entitled under this section, against the total
88	88	amount required under Section 41.093 for the district to purchase
89	89	attendance credits.
90	90	(c) A determination by the commissioner under this section
91	91	is final and may not be appealed.
92	92	(d) The commissioner may adopt rules to implement this
93	93	section.
94	94	SECTION 4. This Act applies beginning with the 2009-2010
95	95	school year.
96	96	SECTION 5. This Act takes effect September 1, 2009.
