99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.402, Education Code, is amended by
1111 amending Subsections (c) and (d) and adding Subsection (c-1) to

3232 (c-1) Notwithstanding Subsection (a), a classroom teacher,
3333 full-time librarian, full-time counselor certified under
3434 Subchapter B, or full-time school nurse is entitled to a monthly
3535 salary that is at least equal to the sum of:
3636 (1) the monthly salary the employee would have
3737 received for the current school year under the district's salary
3838 schedule for the 2008-2009 school year, if that schedule had been in
3939 effect for the current school year, including any local supplement
4040 and any money representing a career ladder supplement the employee
4141 would have received in the current school year; and
4242 (2) the following applicable amount, depending on the
4343 employee's years of experience:
4444 (A) $200, if the employee has less than six years
4545 of experience;
4646 (B) $300, if the employee has at least six but
4747 less than 11 years of experience;
4848 (C) $400, if the employee has at least 11 but less
4949 than 16 years of experience; or
5050 (D) $500, if the employee has at least 16 years of
5151 experience.
5252 (d) A classroom teacher, full-time librarian, full-time
5353 counselor certified under Subchapter B, or full-time school nurse
5454 employed by a school district in the 2009-2010 [2006-2007] school
5555 year is, as long as the employee is employed by the same district,
5656 entitled to a salary that is at least equal to the salary the
5757 employee received for the 2009-2010 [2006-2007] school year.
5858 SECTION 2. Section 42.2516, Education Code, is amended by
5959 adding Subsection (e-1) to read as follows:
6060 (e-1) The amount of state aid or credit to which a school
6161 district is entitled under Section 42.2518 is in addition to the
6262 amount of revenue to which the district is entitled under
6363 Subsection (b).
6464 SECTION 3. Subchapter E, Chapter 42, Education Code, is
6565 amended by adding Section 42.2518 to read as follows:
6666 Sec. 42.2518. ADDITIONAL STATE AID OR CREDIT AGAINST COST
6767 OF ATTENDANCE CREDITS FOR PROFESSIONAL STAFF SALARIES. (a) A
6868 school district, including a school district that is otherwise
6969 ineligible for state aid under this chapter, is entitled to state
7070 aid in an amount, as determined by the commissioner, equal to the
7171 sum of the following amounts, as determined by the number of
7272 classroom teachers, full-time librarians, full-time counselors
7373 certified under Subchapter B, Chapter 21, and full-time school
7474 nurses employed by the district and entitled to a minimum salary
7575 under Section 21.402:
7676 (1) $2,000 multiplied by the number of eligible
7777 employees with less than six years of experience;
7878 (2) $3,000 multiplied by the number of eligible
7979 employees with at least six but less than 11 years of experience;
8080 (3) $4,000 multiplied by the number of eligible
8181 employees with at least 11 but less than 16 years of experience; and
8282 (4) $5,000 multiplied by the number of eligible
8383 employees with at least 16 years of experience.
8484 (b) A school district that is required to take action under
8585 Chapter 41 to reduce its wealth per student to the equalized wealth
8686 level is entitled to a credit, in the amount of state aid to which
8787 the district is entitled under this section, against the total
8888 amount required under Section 41.093 for the district to purchase
8989 attendance credits.
9090 (c) A determination by the commissioner under this section
9191 is final and may not be appealed.
9292 (d) The commissioner may adopt rules to implement this
9393 section.
9494 SECTION 4. This Act applies beginning with the 2009-2010
9595 school year.
9696 SECTION 5. This Act takes effect September 1, 2009.
