55 AN ACT
66 relating to a student health services fee at component institutions
77 of The Texas A&M University System and to authorizing the
88 financing, construction, maintenance, and improvement of health
99 facilities with the fee at the institutions.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Section 54.507, Education Code,
1212 is amended to read as follows:
1313 Sec. 54.507. STUDENT HEALTH [GROUP HOSPITAL AND MEDICAL]
1414 SERVICES FEE [FEES]; TEXAS A&M UNIVERSITY SYSTEM.
1515 SECTION 2. Section 54.507, Education Code, is amended by
1616 amending Subsections (a) and (c) and adding Subsection (a-1) to
1717 read as follows:
1818 (a) The Board of Regents of The Texas A&M University System
1919 may charge [levy and collect from] each student enrolled at a
2020 component [any] institution of [higher education which is a part
2121 of] The Texas A&M University System a student health [compulsory
2222 group hospital and medical] services fee not to exceed $75 for each
2323 regular semester and not to exceed $25 for each summer term [of each
2424 summer session]. The student health [compulsory group hospital and
2525 medical] services fee may not be charged [levied] unless [the levy
2626 of] the fee has been approved by a majority vote of those students
2727 at the affected institution participating in a general student
2828 election called for that purpose.
2929 (a-1) This subsection applies only to Texas A&M University
3030 in College Station. Notwithstanding Subsection (a), the Board of
3131 Regents of The Texas A&M University System may charge each student
3232 enrolled at an institution to which this subsection applies a
3333 student health services fee not to exceed $100 for each regular
3434 semester or $50 for each summer term. The fee may not be increased
3535 by more than 10 percent of the total amount of the fee that is in
3636 effect on January 1, 2009, or as last approved by a student vote
3737 under this section, if applicable, unless the increase has been
3838 approved by a majority vote of the students voting in an election
3939 held for that purpose.
4040 (c) A fee charged [levied] under this section at a component
4141 institution of The Texas A&M University System may be used [only] to
4242 provide hospital or other medical services to students registered
4343 at that component institution and for financing, constructing,
4444 maintaining, and improving new and existing student health
4545 facilities at that institution.
4646 SECTION 3. This Act applies beginning with the 2009 fall
4747 semester.
4848 SECTION 4. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2009.
