|---|
| 9 | 9 | | facilities with the fee at the institutions. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Section 54.507, Education Code, |
|---|
| 12 | 12 | | is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 54.507. STUDENT HEALTH [GROUP HOSPITAL AND MEDICAL] |
|---|
| 14 | 14 | | SERVICES FEE [FEES]; TEXAS A&M UNIVERSITY SYSTEM. |
|---|
| 15 | 15 | | SECTION 2. Section 54.507, Education Code, is amended by |
|---|
| 16 | 16 | | amending Subsections (a) and (c) and adding Subsection (a-1) to |
|---|
| 17 | 17 | | read as follows: |
|---|
| 18 | 18 | | (a) The Board of Regents of The Texas A&M University System |
|---|
| 19 | 19 | | may charge [levy and collect from] each student enrolled at a |
|---|
| 20 | 20 | | component [any] institution of [higher education which is a part |
|---|
| 21 | 21 | | of] The Texas A&M University System a student health [compulsory |
|---|
| 22 | 22 | | group hospital and medical] services fee not to exceed $75 for each |
|---|
| 23 | 23 | | regular semester and not to exceed $25 for each summer term [of each |
|---|
| 24 | 24 | | summer session]. The student health [compulsory group hospital and |
|---|
| 25 | 25 | | medical] services fee may not be charged [levied] unless [the levy |
|---|
| 26 | 26 | | of] the fee has been approved by a majority vote of those students |
|---|
| 27 | 27 | | at the affected institution participating in a general student |
|---|
| 28 | 28 | | election called for that purpose. |
|---|
| 29 | 29 | | (a-1) This subsection applies only to Texas A&M University |
|---|
| 30 | 30 | | in College Station. Notwithstanding Subsection (a), the Board of |
|---|
| 31 | 31 | | Regents of The Texas A&M University System may charge each student |
|---|
| 32 | 32 | | enrolled at an institution to which this subsection applies a |
|---|
| 33 | 33 | | student health services fee not to exceed $100 for each regular |
|---|
| 34 | 34 | | semester or $50 for each summer term. The fee may not be increased |
|---|
| 35 | 35 | | by more than 10 percent of the total amount of the fee that is in |
|---|
| 36 | 36 | | effect on January 1, 2009, or as last approved by a student vote |
|---|
| 37 | 37 | | under this section, if applicable, unless the increase has been |
|---|
| 38 | 38 | | approved by a majority vote of the students voting in an election |
|---|
| 39 | 39 | | held for that purpose. |
|---|
| 40 | 40 | | (c) A fee charged [levied] under this section at a component |
|---|
| 41 | 41 | | institution of The Texas A&M University System may be used [only] to |
|---|
| 42 | 42 | | provide hospital or other medical services to students registered |
|---|
| 43 | 43 | | at that component institution and for financing, constructing, |
|---|
| 44 | 44 | | maintaining, and improving new and existing student health |
|---|
| 45 | 45 | | facilities at that institution. |
|---|
| 46 | 46 | | SECTION 3. This Act applies beginning with the 2009 fall |
|---|
| 47 | 47 | | semester. |
|---|
| 48 | 48 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 52 | 52 | | Act takes effect September 1, 2009. |
