| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter E, Chapter 121, Utilities Code, is |
|---|
| 10 | 10 | | amended by adding Section 121.212 to read as follows: |
|---|
| 11 | 11 | | Sec. 121.212. PIPELINE SAFETY FUND. (a) The pipeline |
|---|
| 12 | 12 | | safety fund is created as a special account in the general revenue |
|---|
| 13 | 13 | | fund. The fund consists of: |
|---|
| 14 | 14 | | (1) fees collected under Section 121.211; |
|---|
| 15 | 15 | | (2) civil penalties and administrative penalties |
|---|
| 16 | 16 | | collected for violations under Subchapters E and F; |
|---|
| 17 | 17 | | (3) civil penalties collected for violations under |
|---|
| 18 | 18 | | Section 121.302; |
|---|
| 19 | 19 | | (4) administrative penalties collected for violations |
|---|
| 20 | 20 | | of Section 121.304(a)(2); |
|---|
| 21 | 21 | | (5) civil penalties collected for violations under |
|---|
| 22 | 22 | | Chapters 117 and 118, Natural Resources Code; |
|---|
| 23 | 23 | | (6) criminal penalties collected under Chapter 117, |
|---|
| 24 | 24 | | Natural Resources Code; and |
|---|
| 25 | 25 | | (7) settlement amounts collected by the attorney |
|---|
| 26 | 26 | | general under Subdivisions (1)-(5). |
|---|
| 27 | 27 | | (b) Amounts deposited in the fund may be appropriated only |
|---|
| 28 | 28 | | to the railroad commission for: |
|---|
| 29 | 29 | | (1) the implementation and enforcement of the pipeline |
|---|
| 30 | 30 | | safety standards and practices of: |
|---|
| 31 | 31 | | (A) Chapters 117 and 118, Natural Resources Code; |
|---|
| 32 | 32 | | (B) Subchapters E and F; and |
|---|
| 33 | 33 | | (C) Section 756.126, Health and Safety Code; and |
|---|
| 34 | 34 | | (2) the performance of other pipeline safety duties |
|---|
| 35 | 35 | | under 49 U.S.C. Section 60101 et seq., or a succeeding law. |

| 36 | 36 | | SECTION 2. Section 121.211(h), Utilities Code, is repealed. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2009. |
