66 AN ACT
77 relating to the creation of the pipeline safety fund.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter E, Chapter 121, Utilities Code, is
1010 amended by adding Section 121.212 to read as follows:
1111 Sec. 121.212. PIPELINE SAFETY FUND. (a) The pipeline
1212 safety fund is created as a special account in the general revenue
1313 fund. The fund consists of:
1414 (1) fees collected under Section 121.211;
1515 (2) civil penalties and administrative penalties
1616 collected for violations under Subchapters E and F;
1717 (3) civil penalties collected for violations under
1818 Section 121.302;
1919 (4) administrative penalties collected for violations
2020 of Section 121.304(a)(2);
2121 (5) civil penalties collected for violations under
2222 Chapters 117 and 118, Natural Resources Code;
2323 (6) criminal penalties collected under Chapter 117,
2424 Natural Resources Code; and
2525 (7) settlement amounts collected by the attorney
2626 general under Subdivisions (1)-(5).
2727 (b) Amounts deposited in the fund may be appropriated only
2828 to the railroad commission for:
2929 (1) the implementation and enforcement of the pipeline
3030 safety standards and practices of:
3131 (A) Chapters 117 and 118, Natural Resources Code;
3232 (B) Subchapters E and F; and
3333 (C) Section 756.126, Health and Safety Code; and
3434 (2) the performance of other pipeline safety duties
3535 under 49 U.S.C. Section 60101 et seq., or a succeeding law.
3636 SECTION 2. Section 121.211(h), Utilities Code, is repealed.
3737 SECTION 3. This Act takes effect September 1, 2009.
