9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 29.005, Education Code, is amended by |
---|
11 | 11 | | adding Subsection (b-1) to read as follows: |
---|
12 | 12 | | (b-1) Unless otherwise provided by federal law, a member of |
---|
13 | 13 | | the committee established under Subsection (a) or any other person |
---|
14 | 14 | | associated with the committee is not entitled to have an attorney |
---|
15 | 15 | | present at a committee meeting. |
---|
16 | 16 | | SECTION 2. Section 29.006, Education Code, is amended to |
---|
17 | 17 | | read as follows: |
---|
18 | 18 | | Sec. 29.006. CONTINUING ADVISORY COMMITTEE. (a) The |
---|
19 | 19 | | governor shall appoint a continuing advisory committee, composed of |
---|
20 | 20 | | 17 members, under 20 U.S.C. Section 1412(a)(21). The appointments |
---|
21 | 21 | | are not subject to confirmation by the senate. Members of the |
---|
22 | 22 | | committee are appointed for staggered terms of four years with the |
---|
23 | 23 | | terms of eight or nine members expiring on February 1 of each |
---|
24 | 24 | | odd-numbered year. |
---|
25 | 25 | | (b) The agency shall promptly provide the continuing |
---|
26 | 26 | | advisory committee with a copy of each written decision resulting |
---|
27 | 27 | | from a special education due process hearing conducted by or on |
---|
28 | 28 | | behalf of the agency in accordance with 20 U.S.C. Section 1415. |
---|
29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
---|
30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
---|
31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
---|
33 | 33 | | Act takes effect September 1, 2009. |
