55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to procedures applicable to the provision of special
88 education services to public school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.005, Education Code, is amended by
1111 adding Subsection (b-1) to read as follows:
1212 (b-1) Unless otherwise provided by federal law, a member of
1313 the committee established under Subsection (a) or any other person
1414 associated with the committee is not entitled to have an attorney
1515 present at a committee meeting.
1616 SECTION 2. Section 29.006, Education Code, is amended to
1717 read as follows:
1818 Sec. 29.006. CONTINUING ADVISORY COMMITTEE. (a) The
1919 governor shall appoint a continuing advisory committee, composed of
2020 17 members, under 20 U.S.C. Section 1412(a)(21). The appointments
2121 are not subject to confirmation by the senate. Members of the
2222 committee are appointed for staggered terms of four years with the
2323 terms of eight or nine members expiring on February 1 of each
2424 odd-numbered year.
2525 (b) The agency shall promptly provide the continuing
2626 advisory committee with a copy of each written decision resulting
2727 from a special education due process hearing conducted by or on
2828 behalf of the agency in accordance with 20 U.S.C. Section 1415.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
