| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 223.047(b), Transportation Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (b) In comparing bids submitted for road construction that | |
| 13 | 13 | require paving, the department, a county, or a municipality shall | |
| 14 | 14 | [may] give a preference to a bid that provides for using, as a part | |
| 15 | 15 | of the paving material, rubberized asphalt paving described by | |
| 16 | 16 | Subsection (a) if the cost of that paving material does not exceed | |
| 17 | 17 | by more than 15 percent the bid cost of alternative paving materials | |
| 18 | 18 | for the same job. The cost of the materials must be determined by a | |
| 19 | 19 | life-cycle cost benefit analysis. | |
| 20 | 20 | SECTION 2. Section 223.047, Transportation Code, as amended | |
| 21 | 21 | by this Act, applies only to a request for bids issued by or on | |
| 22 | 22 | behalf of the Texas Department of Transportation, a county, or a | |
| 23 | 23 | municipality on or after September 1, 2009. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2009. |
