66 AN ACT
77 relating to the implementation by the comptroller of a low-emission
88 vehicle program for the state vehicle fleet.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 2171, Government Code, is
1111 amended by adding Section 2171.106 to read as follows:
1212 Sec. 2171.106. LOW-EMISSION VEHICLE PROGRAM. (a) In this
1313 section, "California Low-Emission Vehicle program" means the
1414 low-emission vehicle program being implemented in California
1515 pursuant to the provisions of the federal Clean Air Act (42 U.S.C.
1616 Section 7401 et seq.) and the California Code of Regulations.
1717 (b) The comptroller shall implement a low-emission vehicle
1818 program for the state vehicle fleet that is consistent with the
1919 California Low-Emission Vehicle program.
2020 (c) The comptroller shall adopt rules as necessary to
2121 implement this section in a manner that maintains consistency with
2222 the California Low-Emission Vehicle program.
2323 (d) Notwithstanding Subsections (b) and (c), if after the
2424 effective date of the law enacting this section California adopts
2525 standards relating to the control of emissions from new motor
2626 vehicles or new motor vehicle engines that are inconsistent with
2727 the California Low-Emission Vehicle program as that program existed
2828 on the effective date of the law enacting this section or if after
2929 that date the federal standards relating to the control of
3030 emissions from new motor vehicles or new motor vehicle engines are
3131 amended, the comptroller may adopt the federal standards if the
3232 comptroller determines that the federal standards provide a more
3333 cost-effective method of achieving any reductions in emissions of
3434 air contaminants required by state or federal law.
3535 SECTION 2. Section 2158.009, Government Code, is repealed.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2009.
