| 7 | 7 | | relating to the implementation by the comptroller of a low-emission |

| 8 | 8 | | vehicle program for the state vehicle fleet. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 2171, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 2171.106 to read as follows: |
|---|
| 12 | 12 | | Sec. 2171.106. LOW-EMISSION VEHICLE PROGRAM. (a) In this |
|---|
| 13 | 13 | | section, "California Low-Emission Vehicle program" means the |
|---|
| 14 | 14 | | low-emission vehicle program being implemented in California |
|---|
| 15 | 15 | | pursuant to the provisions of the federal Clean Air Act (42 U.S.C. |
|---|
| 16 | 16 | | Section 7401 et seq.) and the California Code of Regulations. |
|---|
| 17 | 17 | | (b) The comptroller shall implement a low-emission vehicle |
|---|
| 18 | 18 | | program for the state vehicle fleet that is consistent with the |
|---|
| 19 | 19 | | California Low-Emission Vehicle program. |
|---|
| 20 | 20 | | (c) The comptroller shall adopt rules as necessary to |
|---|
| 21 | 21 | | implement this section in a manner that maintains consistency with |
|---|
| 22 | 22 | | the California Low-Emission Vehicle program. |
|---|
| 23 | 23 | | (d) Notwithstanding Subsections (b) and (c), if after the |
|---|
| 24 | 24 | | effective date of the law enacting this section California adopts |
|---|
| 25 | 25 | | standards relating to the control of emissions from new motor |
|---|
| 26 | 26 | | vehicles or new motor vehicle engines that are inconsistent with |
|---|
| 27 | 27 | | the California Low-Emission Vehicle program as that program existed |
|---|
| 28 | 28 | | on the effective date of the law enacting this section or if after |
|---|
| 29 | 29 | | that date the federal standards relating to the control of |
|---|
| 30 | 30 | | emissions from new motor vehicles or new motor vehicle engines are |
|---|
| 31 | 31 | | amended, the comptroller may adopt the federal standards if the |
|---|
| 32 | 32 | | comptroller determines that the federal standards provide a more |
|---|
| 33 | 33 | | cost-effective method of achieving any reductions in emissions of |
|---|
| 34 | 34 | | air contaminants required by state or federal law. |
|---|
| 35 | 35 | | SECTION 2. Section 2158.009, Government Code, is repealed. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2009. |
