55 relating to information regarding the relative or designated
66 caregivers for a child in the managing conservatorship of the
77 state.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 262.114, Family Code, is amended by
1010 adding Subsections (a-1) and (a-2) to read as follows:
1111 (a-1) At the full adversary hearing under Section 262.201,
1212 the department shall, after redacting any social security numbers,
1313 file with the court:
1414 (1) a copy of each proposed child placement resources
1515 form completed by the parent or other person having legal custody of
1616 the child;
1717 (2) a copy of any completed home study performed under
1818 Subsection (a); and
1919 (3) the name of the relative or other designated
2020 caregiver, if any, with whom the child has been placed.
2121 (a-2) If the child has not been placed with a relative or
2222 other designated caregiver by the time of the full adversary
2323 hearing under Section 262.201, the department shall file with the
2424 court a statement that explains:
2525 (1) the reasons why the department has not placed the
2626 child with a relative or other designated caregiver listed on the
2727 proposed child placement resources form; and
2828 (2) the actions the department is taking, if any, to
2929 place the child with a relative or other designated caregiver.
3030 SECTION 2. Subsection (c), Section 262.201, Family Code, is
3131 amended to read as follows:
3232 (c) If the court finds sufficient evidence to satisfy a
3333 person of ordinary prudence and caution that there is a continuing
3434 danger to the physical health or safety of the child and for the
3535 child to remain in the home is contrary to the welfare of the child,
3636 the court shall issue an appropriate temporary order under Chapter
3737 105. The court shall require each parent, alleged father, or
3838 relative of the child before the court to complete [submit] the
3939 proposed child placement resources form provided under Section
4040 261.307 and file the form with the court, if the form has not been
4141 previously filed with the court [provided], and provide the
4242 Department of Family and Protective Services with information
4343 necessary to locate any other absent parent, alleged father, or
4444 relative of the child. The court shall inform each parent, alleged
4545 father, or relative of the child before the court that the person's
4646 failure to submit the proposed child placement resources form will
4747 not delay any court proceedings relating to the child. The court
4848 shall inform each parent in open court that parental and custodial
4949 rights and duties may be subject to restriction or to termination
5050 unless the parent or parents are willing and able to provide the
5151 child with a safe environment. If the court finds that the child
5252 requires protection from family violence by a member of the child's
5353 family or household, the court shall render a protective order
5454 under Title 4 for the child. In this subsection, "family violence"
5555 has the meaning assigned by Section 71.004.
5656 SECTION 3. Subchapter A, Chapter 263, Family Code, is
5757 amended by adding Section 263.003 to read as follows:
5858 Sec. 263.003. INFORMATION RELATING TO PLACEMENT OF CHILD.
5959 (a) Except as provided by Subsection (b), not later than the 10th
6060 day before the date set for a hearing under this chapter, the
6161 department shall file with the court any document described by
6262 Sections 262.114(a-1) and (a-2) that has not been filed with the
6363 court.
6464 (b) The department is not required to file the documents
6565 required by Subsection (a) if the child is in an adoptive placement
6666 or another placement that is intended to be permanent.
6767 SECTION 4. Subsections (a-1) and (a-2), Section 262.114,
6868 and Section 263.003, Family Code, as added by this Act, apply only
6969 to a suit affecting the parent-child relationship filed by the
7070 Department of Family and Protective Services on or after the
7171 effective date of this Act. A suit filed before the effective date
7272 of this Act is governed by the law in effect on the date the suit was
7373 filed, and the former law is continued in effect for that purpose.
7474 SECTION 5. This Act takes effect September 1, 2009.
