7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Subchapter B, Chapter 241, Health and Safety | |
9 | 9 | Code is amended by adding Section 241.0261 to read as follows: | |
10 | 10 | Sec. 241.0261. PHYSICIAN STAFFING REQUIREMENTS. | |
11 | 11 | (a) Notwithstanding any other law, the department may not require | |
12 | 12 | a hospital to have more restrictive staffing requirements to | |
13 | 13 | emergency medical care than are required by federal law. | |
14 | 14 | SECTION 2. This Act takes effect immediately if it receives | |
15 | 15 | a vote of two-thirds of all the members elected to each house, as | |
16 | 16 | provided by Section 39, Article III, Texas Constitution. If this | |
17 | 17 | Act does not receive the vote necessary for immediate effect, this | |
18 | 18 | Act takes effect September 1, 2009. |
