1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the management and control of certain utility systems.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subsection (a), Section 1502.070, Government
1515 Code, is amended to read as follows:
1616 (a) Management and control of a utility system may be vested
1717 in:
1818 (1) the municipality's governing body; or
1919 (2) a board of trustees named in the proceedings
2020 adopted by the municipality and consisting of not more than:
2121 (A) five members, one of whom must be the mayor of
2222 the municipality; or
2323 (B) seven members, one of whom must be the mayor
2424 of the municipality, if the municipality is located in a county:
2525 (i) with a population of at least 600,000;
2626 and
2727 (ii) that is located on an international
2828 border.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
