| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 47.01, Penal Code, is amended by adding | |
| 11 | 11 | Subdivision (4-a) to read as follows: | |
| 12 | 12 | (4-a) "Device" or "contrivance" means all or part of | |
| 13 | 13 | an electronic, electromechanical, or mechanical contrivance, | |
| 14 | 14 | machine, or apparatus. | |
| 15 | 15 | SECTION 2. (a) The change in law made by this Act applies | |
| 16 | 16 | only to an offense committed on or after the effective date of this | |
| 17 | 17 | Act. For purposes of this section, an offense is committed before | |
| 18 | 18 | the effective date of this Act if any element of the offense occurs | |
| 19 | 19 | before that date. | |
| 20 | 20 | (b) An offense committed before the effective date of this | |
| 21 | 21 | Act is covered by the law in effect immediately before the effective | |
| 22 | 22 | date of this Act, and the former law is continued in effect for that | |
| 23 | 23 | purpose. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2009. |
