77 relating to the higher education fund and the allocation and
88 distribution of certain constitutional revenues to The University
99 of Texas at Brownsville.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 62.021(a), Education Code, is amended to
1212 read as follows:
1313 (a) In each state fiscal year beginning with the state
1414 fiscal year ending August 31, 2008, an eligible institution is
1515 entitled to receive an amount allocated in accordance with this
1616 section from funds appropriated for that year by Section 17(a),
1717 Article VII, Texas Constitution. The comptroller shall distribute
1818 funds allocated under this subsection only on presentation of a
1919 claim and issuance of a warrant in accordance with Section 403.071,
2020 Government Code. The comptroller may not issue a warrant from any
2121 funds allocated under this subsection before the delivery of goods
2222 or services described in Section 17, Article VII, Texas
2323 Constitution, except for the payment of principal or interest on
2424 bonds or notes or for a payment for a book or other published
2525 library material as authorized by Section 2155.386, Government
2626 Code. The allocation of funds under this subsection is made in
2727 accordance with an equitable formula consisting of the following
2828 elements: space deficit, facilities condition, institutional
2929 complexity, and a separate allocation for the Texas State Technical
3030 College System. The annual amounts allocated by the formula are as
3131 follows:

3333 (2) $26,137,233 to the University of North Texas;
3434 (3) $8,139,391 to the University of North Texas Health
3535 Science Center at Fort Worth;
3636 (4) $12,882,348 to The University of Texas--Pan

9292 SECTION 2. This Act takes effect September 1, 2010, but only
9393 if the constitutional amendment proposed by the 81st Legislature,
9494 Regular Session, 2009, entitling The University of Texas at
9595 Brownsville to participate in the income and other benefits of the
9696 permanent university fund, takes effect. If that amendment is not
9797 approved by the voters, this Act has no effect.
