| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 9002.101, Special District Local Laws |
|---|
| 9 | 9 | | Code, is amended by amending Subsection (a) and adding Subsection |
|---|
| 10 | 10 | | (d) to read as follows: |
|---|
| 11 | 11 | | (a) To the extent authorized by Section 52, Article III, |
|---|
| 12 | 12 | | Texas Constitution, the district may construct, acquire, improve, |
|---|
| 13 | 13 | | maintain, or operate macadamized, graveled, or paved roads [or |
|---|
| 14 | 14 | | turnpikes], or improvements in aid of those roads [or turnpikes, |
|---|
| 15 | 15 | | inside the district]. |
|---|
| 16 | 16 | | (d) The district may not exercise the power of eminent |
|---|
| 17 | 17 | | domain outside the district to acquire a site or easement for a road |
|---|
| 18 | 18 | | project authorized by this section. |
|---|
| 19 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2009. |
